Compliance requirements

The bidder must confirm that neither it nor its management, administrative or supervisory body members or representatives has received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or human trafficking. Where relevant, the bidder must provide conviction details and describe measures taken to restore its reliability.\n\nExclusion grounds may also include tax or social security arrears, bankruptcy or another insolvency proceeding, liquidation, assets being administered by a liquidator or court, suspended business activities, serious professional misconduct, agreements restricting competition, a conflict of interest, involvement in preparing the procurement, a material breach or early termination of a previous procurement contract, false information, or failure to provide required information or documents. The bidder must also confirm compliance with environmental, social and labour-law obligations.\n\nUnder Estonian law, the notice additionally addresses offences related to enabling an unlawfully staying foreign national to work, international sanctions, and convictions for tax offences. Tax and social security obligations must have been fulfilled, or a binding arrangement for their payment must have been concluded.

Qualification criteria and exclusion grounds
