Compliance requirements

The bidder must confirm that none of the mandatory exclusion grounds apply. These include final convictions within the relevant period, or an ongoing exclusion obligation, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, the illegal use of child labour or human trafficking. Exclusion also applies where the bidder has tax, payment or social security contribution arrears, or where awarding the contract would breach an international or government sanction. The bidder must also confirm that it is not established or resident in the Russian Federation or Belarus. The contracting authority may additionally exclude a bidder that has seriously or persistently breached a previous public contract, or has submitted false information or failed to provide required qualification information or documents. A further discretionary ground concerns convictions for tax offences. The bidder must provide the required declarations and, where requested, supporting evidence.

Qualification criteria and exclusion grounds

The bidder must meet the following qualification and compliance requirements: - The net turnover in each of the bidder’s three most recently completed financial years must be at least EUR 100,000. The turnover must arise from engineering and related technical consultancy, construction engineering design and consultancy, other engineering activities, electricity and communications network construction, or equivalent activities. The bidder must submit extracts from the three relevant annual accounts showing the turnover, unless the information is publicly available to the contracting authority from a register. If the relevant activity is not shown under the specified classification, the bidder may have to provide a reasoned explanation. Non-Estonian bidders must use the corresponding NACE classification. - The bidder must submit a list of completed reference projects from the 60 months preceding the start of the procurement, using Form 2 for designer references. - The persons performing the framework agreement must include at least one electrical engineer holding a valid Level 7 professional certificate for electricity networks and systems, with design as the selected area of work, or an equivalent A-level competence. Valid supporting evidence must be submitted for at least one person. - The price offer must be submitted on Form 3. The bidder must provide a coefficient used to calculate unit prices and the total offer price from the contracting authority’s VAT-exclusive base prices. The indicative quantities are estimates and are not binding. The price table must not be altered; an altered table or altered quantities will make the offer non-compliant. Form 3 must be submitted in XLS or XLSX format. - Joint bidders must appoint an authorised representative from among themselves and submit the relevant power of attorney with the offer. - The bidder must be prepared to use the contracting authority’s electronic drawings, databases, software and working environments, including Trimble Unity and the EPP environment. - The bidder must identify and justify any business secrets in the offer. The offer price and other protected numerical indicators used for evaluation may not be designated as business secrets.
