Purchase of maintenance and repair services for road and railway scales

The bidder, its representative, management or supervisory board member, procurist or other authorised person must not have been convicted of participation in a criminal organisation, breach of the duty of integrity, corruption, fraud, terrorism or terrorist-related assistance, money laundering or terrorist financing. The relevant persons must also not have been convicted of illegally enabling a foreign national residing in the country to work or of violating the conditions for a foreign national’s employment in Estonia, including paying less than the required wage, or of the unlawful use of child labour or an act related to human trafficking. The bidder must not have outstanding state tax, payment or environmental charge debts, or tax or social security payment arrears under the law of its country of establishment. Contract award must not breach an international sanction or a sanction imposed by the Government of the Republic of Estonia. The bidder must confirm that none of these exclusion grounds applies to it.

Where required by the law of its country of establishment, the bidder must be registered in the relevant commercial register and, where necessary, provide documentary proof of registration. A bidder established in Estonia does not have to submit a separate copy of its commercial register registration. The bidder or its subcontractor must have completed at least one comparable contract during the 36 months preceding the launch of the procurement. The contract must have concerned maintenance and/or repair services for road scales and/or railway scales. This must be demonstrated using Form 2, listing the contract name, a brief description, the performance period and the other contracting party for each contract. If the bidder relies on a subcontractor’s reference, that subcontractor must be identified in the tender so that the contracting authority can carry out the required exclusion-ground checks. The bidder must confirm that it has the technical capability to perform the maintenance and repair, calibration and software-update work described in the procurement specifications. The tender must comply with all tender-document requirements, and conditional tenders are not permitted. Form 1 must be submitted with all required fields completed, and the total tender price must follow the prescribed structure. In a joint tender, an authorisation from the joint tenderers must be included. Any trade secret must be identified and justified; the tender price and other prohibited numerical indicators related to the award criteria may not be classified as trade secrets.
