Compliance requirements
The bidder must confirm that neither the bidder nor its administrative, management or supervisory body members, prosecutors, or persons authorised to represent, control or make decisions for the bidder have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, unlawful use of child labour or other human-trafficking-related offences, and that no exclusion period resulting from such a conviction remains in force.
Exclusion may also apply where the bidder has failed to meet its tax or social security payment obligations. The bidder must additionally confirm that it has not breached requirements concerning the employment of foreign nationals staying in Estonia without a legal basis, and that awarding the contract to it would not breach an international or Estonian Republic sanction.
Where an exclusion ground exists, the contracting authority may, where permitted, consider evidence of measures taken to restore the bidder’s reliability. The ESPD must be completed for each ground, with details of convictions, tax or social security debt, electronic sources or other evidence provided where applicable.
Qualification criteria and exclusion grounds
The bidder must provide at least one owner’s supervision manager who is a level 7 certified structural engineer or a level 8 authorised structural engineer, with a specialisation in harbour construction and competence in owner’s supervision, or an equivalent professional qualification. The qualification must allow the specialist to perform owner’s supervision for the construction of port and water structures, including quays, shoreline structures and related constructions. The bid must include the proposed specialist’s name and professional qualification details; a separate certificate is not required where the qualification can be verified in a public register.
Within the 36 months preceding the start of the procurement, the bidder must have properly completed at least one owner’s supervision or construction supervision services contract. The reference must concern the construction or reconstruction of a port, quay, bridge, shoreline structure, water structure or technically comparable facility. The supervision must have covered at least the construction or reconstruction of load-bearing structures and concrete or metal structures. The bidder must provide a description of the contract, its performance period and the details of the other contracting party.
The bid must comply with all tender document requirements, and conditional bids are not permitted. The price must be submitted using the structure specified in the evaluation sheet and Form 1 – Price offer. Any business secret and the reasons for its classification must be identified in the bid; the bid price and numerical figures related to evaluation may not be classified as business secrets.
