Compliance requirements

The bidder must confirm that the bidder, its management or supervisory board members, and its authorised representatives have not been finally convicted within the last five years of offences including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing or unlawful use of child labour. The checks also cover payment of taxes and social security contributions and compliance with environmental, social and labour-law obligations. The exclusion grounds also include bankruptcy, liquidation or another insolvency situation, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, an unfair advantage arising from involvement in preparing the procurement, material breaches of previous public contracts, and the submission of false information or failure to provide required documents. They also cover enabling the employment of unlawfully staying foreign nationals, breaches of international or national sanctions, tax offences and restrictions on participation in the procurement. Where applicable, the bidder must provide explanations, evidence and information on measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The bidder’s net turnover for the last financial year completed before the start of the procurement must be at least EUR 100,000. The turnover must be declared in the European Single Procurement Document and, upon request, proven by an extract from the annual accounts or another relevant document. If turnover is demonstrated using another entity’s resources, the bidder must submit that entity’s procurement document, consent and the required information; the entity whose turnover is relied upon is jointly liable with the bidder for the relevant part of the contract. Within the 36 months preceding the start of the procurement, the bidder must have properly completed at least one architectural design contract covering a publicly used building and its outdoor area, with a value of at least EUR 30,000 excluding VAT. A publicly used building may include a museum, theatre, school, sports facility or another building intended for the public or a wider group of users. The procurement document must include the work description, value, performance period, client details and the bidder’s area of responsibility. Upon request, the bidder must provide a client confirmation of proper completion, the performance period and the value excluding VAT. If another entity’s technical and professional capacity is used, that entity’s procurement document, consent and confirmation of direct participation in performance must be submitted. The tender must include a preliminary design proposal with the concept diagrams necessary to describe the proposed solution. The proposal must be in Estonian or accompanied by an Estonian translation and submitted in a commonly readable file format; it will be used in tender evaluation. All cost fields in the price breakdown must be completed, with prices stated in euros excluding VAT to two decimal places. The bidder must confirm acceptance of the contract notice and tender document conditions and confirm that its team meets the requirements set out in the draft contract. For a joint tender, separate procurement documents for all joint bidders and a power of attorney must be submitted. The bidder must also provide the details of authorised persons not visible from the relevant commercial register, or confirm that no such persons exist.
