Compliance requirements

The bidder and members of its management, representative or supervisory bodies must not have been convicted of participation in a criminal organisation, breach of duty of integrity, corruption, fraud, terrorism, money laundering, enabling the employment of an illegally residing foreign national, breaches of foreign workers’ employment conditions, illegal child labour or trafficking in human beings. The bidder must not have outstanding state tax, payment or environmental charge debts, or tax or social security contribution debts under the laws of its country of establishment. The contracting authority may also exclude a bidder that has seriously or repeatedly breached an earlier public contract, resulting in termination, a price reduction, compensation for damage or a contractual penalty. Exclusion may also apply where the bidder has submitted false information concerning compliance with the qualification requirements or failed to submit required information or documents. Companies established or residing in the Russian Federation or the Republic of Belarus may not participate. Materials, equipment, goods or components produced in or originating from Russia or Belarus may not be used during the works. The contracting authority may request certificates of origin as evidence.

Qualification criteria and exclusion grounds

Within the 60 months preceding the launch of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of this tender. At least one of these contracts must have had a value of at least EUR 40,000 excluding VAT. The bid must include a list of the contracts with their performance periods, information about the other contracting parties and the client’s representative’s contact details, including telephone number and email address. At the contracting authority’s request, the bidder must provide evidence of proper performance. The team must include a person authorised to perform switching operations associated with the works in a 0.22–20 kV electricity network, registered in Elektrilevi’s partner portal before the bids are opened. For low-voltage works only, at least low-voltage switching rights are required; in other cases, both low- and medium-voltage switching rights are required. The team must also include a person responsible for the work operation, registered in the same portal before the bid submission deadline. The team must include a person responsible for managing electrical works who has a valid A-level competence and/or a qualification corresponding to at least level 6 under the Estonian Professions Act, holds the relevant certificate and is registered in Elektrilevi’s partner portal before the bid submission deadline. The bid must comply with all tender document requirements; conditional bids or bids containing additional conditions are not permitted. The price must be submitted using the required table, and every unit-price field must be completed. The bidder must provide the details of the contract signatory or signatories and the contract performance contact person; if the signatory’s authority is not evident from the articles of association, a power of attorney must be attached. The bidder must identify and justify any trade secret, but the bid price and other prohibited evaluation figures may not be classified as trade secrets.
