Compliance requirements

A bidder will be excluded if the company or a member of its administrative, management or supervisory body, procurator, or another person authorised to represent or control it has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism-related offences, money laundering or terrorist financing. Exclusion also applies to convictions for enabling an unlawfully present foreign national to work or enabling employment in Estonia on terms involving pay below the statutory wage rate, as well as offences involving unlawful child labour or human trafficking. The bidder must not have outstanding state tax, payment or environmental charge debts, or tax or social security debts under the law of its country of establishment. The contracting authority may also exclude a bidder for a substantial or repeated breach of a previous public contract where this resulted, for example, in withdrawal from or termination of the contract, a price reduction, compensation for damage or a contractual penalty. Submission of false information about meeting the qualification requirements, or failure to submit required information or documents, may also lead to exclusion. The bidder must confirm that none of the mandatory or discretionary exclusion grounds apply. Companies established or resident in the Russian Federation or the Republic of Belarus may not participate in the procurement.

Qualification criteria and exclusion grounds

During the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of this tender. At least one of these contracts must have had a value of at least EUR 40,000 excluding VAT. The bid must include a list of the contracts stating the performance period, details of the other contracting parties and the client representative’s contact details, including telephone number and email address; public contracts must also include their reference numbers. At the contracting authority’s request, the bidder must provide evidence of proper performance, unless the authority can obtain the information from databases without significant cost. The team must include a person with valid switching authorisations for work-related switching operations in a 0.22–20 kV electricity network. For low-voltage works only, at least low-voltage switching authorisation is required; in other cases, both low- and medium-voltage switching authorisations are required, including where low-voltage works require switching on the medium-voltage side. This person must be registered in Elektrilevi’s partner portal before the bids are opened. The team must also include a person responsible for work operations, registered in the same portal before the bid submission deadline. In addition, the team must include an electrical works manager with valid A competence and/or a qualification corresponding to at least level 6 under the Professional Qualifications Act, the relevant supporting evidence, and registration in Elektrilevi’s partner portal before the bid submission deadline. The bid must comply with all tender document requirements; additional conditions and conditional bids are not permitted. The bid must include a properly completed pricing table with all unit-price fields filled in, the details of the contract signatory and performance contact person, and a power of attorney where necessary. The bidder must identify and justify any trade secret, but may not classify the bid price or other figures used in the evaluation as trade secrets. The standard payment period is 14, 35 or 45 calendar days depending on the contract value; participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period. Materials, equipment, goods and components originating from Russia or Belarus may not be used during performance, and the contracting authority may request certificates of origin.
