Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must declare whether it or its representatives or management have relevant final convictions, including for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking, and tax offences. Grounds also include unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, creditor arrangements or suspended business; serious professional misconduct; anti-competitive agreements; conflicts of interest or involvement in preparing the procurement where competition cannot otherwise be protected; serious or repeated breaches of previous public contracts; false or misleading information, withholding information, failure to submit requested supporting documents, or improper attempts to obtain confidential information. Other grounds include enabling unlawful employment of a foreign national, being subject to applicable international sanctions, local tax debt where applicable, and any restriction on the bidder’s right to participate based on its place of residence or establishment. The tax-debt threshold is stated as EUR 0; the notice notes that, under Estonian rules, a tax-debt certificate is not issued for debt below EUR 100 (excluding interest not determined by an administrative act) or where payment has been deferred. Where permitted, the bidder may provide evidence of remedial measures to demonstrate restored reliability.

Qualification criteria and exclusion grounds

The bidder must be registered in the business register of its country of establishment where registration is required by that country’s law. Its average annual net turnover for 01/01/2023–31/12/2025 must be at least EUR 70,000 per financial year. Joint bidders may aggregate their turnover. The successful bidder must provide extracts from the accounts for the three most recently completed financial years showing net turnover; this is not required from an Estonian-registered company if the information is publicly and freely available to the contracting authority through a data register. Within the 36 months preceding commencement of the procurement, the bidder must have properly completed at least one contract for implementing personnel and self-service software for an organisation with at least 150 users. The bidder must provide the contract details in the ESPD and, if requested, a client confirmation stating the contract period and subject matter. The tender must comply with the procurement documents; conditional tenders are not permitted. The bidder must submit its price using the prescribed structure, confirm coverage of the functional and non-functional requirements, and provide a brief description of the proposed software’s general nature and intended use. For a joint tender, a power of attorney for the joint bidders must be provided. The bidder must identify and justify any information claimed as a trade secret; the tender price and figures relating to the award criteria may not be designated as trade secrets. For exclusion checks, the bidder must provide the names and personal identification codes of authorised persons not visible in the business register card, or confirm that it has no such persons. The bidder must confirm that neither it nor persons acting on its behalf have committed corrupt acts in connection with the procurement.
