Compliance requirements

The bidder must confirm that none of the exclusion grounds under Section 95(1), points 1–5, of the Estonian Public Procurement Act apply. The contracting authority may also exclude a bidder where any of the grounds under Section 95(4), points 2–12, apply. The bidder must additionally confirm that it does not breach any participation restriction imposed by the contracting authority based on the undertaking’s place of establishment or residence. A foreign bidder may be required to submit a criminal records certificate or equivalent document issued in its country, together with a certificate from the competent authority. The bidder must confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers who are Russian Federation nationals, residents or entities established in Russia, or entities directly or indirectly more than 50% owned by such persons or acting under their control or instructions. The offered goods must not be subject to international sanctions or originate from a sanctioned region. The tender may be rejected if these restrictions are breached or the required confirmation is not provided.

Qualification criteria and exclusion grounds

The bidder’s average annual net turnover for the last three financial years completed before the start of the procurement must be at least EUR 2,500,000. If requested, extracts from the approved financial statements for the three latest financial years must be submitted; in a joint tender, each participant must submit its own extracts. During the 36 months preceding the deadline for publication of the contract notice, the bidder must have properly completed at least three contracts similar to the subject matter of the procurement, namely extended owner’s supervision and/or project management services. The combined value of these contracts must be at least EUR 200,000 excluding VAT. The bidder must provide short descriptions, performance periods, contact details of the client’s representative and, where applicable, procurement reference numbers. The bidder must provide the following key personnel and submit their details on the required form: a consultant’s representative or lead owner’s supervision engineer with at least a level 8 authorised civil engineer certificate in building construction and owner’s supervision; a site engineer with at least a level 7 certified civil engineer qualification in building construction and owner’s supervision; a general construction specialist with at least a level 8 authorised civil engineer qualification in building construction and owner’s supervision; a heating, ventilation and cooling systems specialist with at least a level 7 certified engineer qualification and owner’s supervision competence; a water supply and sewerage specialist with at least a level 7 certified engineer qualification in building water supply and sewerage and owner’s supervision; an electrical works specialist with at least a level 7 certified electrical engineer qualification covering building electrical installations, electrical networks and systems, and owner’s supervision; a low-voltage, automation and special systems specialist with at least a level 6 security systems designer qualification; a BIM expert with at least a level 7 certified civil engineer qualification; and a specialist in external structures, utility networks and pavements with at least a level 7 certified road engineer qualification in roads and owner’s supervision. Equivalent qualifications under the relevant national legislation are accepted in all cases.
