Preparation of the construction design for energy-efficiency works at Kiviõli School of Arts

A bidder will be excluded if the company or a person with management, supervisory or representation authority has a conviction for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, facilitating illegal employment, unlawful use of child labour or human trafficking. Exclusion also applies where the bidder has public tax, payment or environmental charge arrears, tax or social security contribution arrears under the law of its country of establishment, or where awarding the contract would breach an international or Government of Estonia sanction. The contracting authority may also exclude a bidder for a substantial or repeated breach of an earlier public contract, or for submitting false information or failing to submit required information or documents. The bidder must provide a declaration confirming that no exclusion grounds apply.

The bidder must have a design team consisting of at least three qualified specialists: a designer for the water supply and sewerage discipline, a designer for heating, ventilation and cooling systems, and a designer for electrical installations. The specialists responsible for design must hold at least a Level 7 Diplomas Engineer professional qualification in the relevant field, or equivalent competence authorising them to design the relevant discipline. One person may perform several roles if their competence covers all corresponding works. The bidder must have a project manager holding a Level 7 Diplomas Engineer professional qualification specialising in building construction, with competence in preparing building designs or managing design work, or equivalent competence. As the site is a monument, the project manager must have, within the last five years, experience in preparing or managing the design of at least one reconstruction project for a monument or a heritage-protected building. Specialist details and declarations must be submitted using Form 1, and the project manager’s details and declaration using Form 2. The bidder, or an undertaking whose competence the bidder relies on, must hold valid economic activity notices for design and for preparing construction designs in the heritage protection field for the conservation and restoration of a monument or a building located at a world heritage site. If the bidder relies on a subcontractor’s competence, the subcontractor’s details and consent must be submitted. The tender must be submitted by the bidder’s legal or authorised representative; where the authority is not evident from the register, a power of attorney must be included. For a joint tender, the bidders must appoint a common representative and submit the power of attorney and confirmation of joint and several liability. The final tender price must be submitted in Appendix 5 and in the register, and must include all costs related to contract performance. The tender must identify and justify any trade secrets, or state that it contains none; the tender price and other prohibited evaluation figures may not be classified as trade secrets.
