Durability study of slurry-sealed road sections

The bidder must confirm that neither it nor persons serving on its management, supervisory or representative bodies have received a final conviction during the last five years for offences including participation in a criminal organisation, corruption, fraud, terrorism, money laundering, terrorist financing, or the illegal use of child labour. The checks also cover enabling an unlawfully staying foreign national to work and other offences specified in the Public Procurement Act. Possible exclusion grounds also include unpaid taxes or social security contributions; breaches of environmental, social or labour-law obligations; bankruptcy or other insolvency proceedings; liquidation; suspended business activity; an agreement with creditors; serious professional misconduct; agreements restricting competition; conflicts of interest; involvement in preparing the procurement; serious breaches of previous public contracts; submission of false information; or failure to provide required information or documents. The contracting authority will also check applicable international or Estonian sanctions and the bidder’s right to participate in the procurement. The bidder must provide the required declarations and, where necessary, supporting evidence. If an exclusion ground applies, evidence of measures taken to restore reliability may be submitted where this is provided for in the tender documents or where the procurement exceeds the international threshold.

The bidder’s net turnover in the latest financial year completed before the procurement started must be at least EUR 85,000.00. Joint bidders may add their turnover figures together. The turnover must be declared in the European Single Procurement Document and, at the contracting authority’s request, supported by an extract from the annual report or another relevant document, unless the information is publicly available from an Estonian register. During the 36 months preceding the start of the procurement, the bidder must have completed at least one contract covering road-surface condition assessment or inventory, development or research work related to road-construction materials, or supervision services related to road-construction works. The bidder must provide the contract name and a brief description, the client’s name and contact details, the contract value, and its start and end dates. If relying on another entity’s capacities, the bidder must submit that entity’s European Single Procurement Document and, at the contracting authority’s request, the relevant undertaking. An entity whose turnover is relied upon will be jointly and severally liable with the bidder for the relevant part of the contract. An entity whose technical or professional capacity is relied upon must directly participate in performing the relevant part of the contract. The bidder must submit a fully completed price breakdown using the required HD IV MS Excel file. All work-item and stage prices must be stated in euros to two decimal places, and the template must not be modified in ways unrelated to completing it. The bidder must confirm acceptance of the conditions in the contract notice and tender documents and must use persons who meet the requirements set out in section 4 of the technical description. Documents evidencing those persons’ experience must be submitted after contract award in accordance with the draft contract.
