The bidder, its management or supervisory board members, and persons authorised to represent or control it must not have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. Exclusion may also apply in cases of unpaid taxes or social security contributions, breaches of environmental, social or labour-law obligations, bankruptcy, liquidation, insolvency proceedings, an agreement with creditors, assets administered by a liquidator or court, or suspended business activities. Further grounds may include serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement in a way that creates an unjustified advantage, a material breach or early termination of a previous public contract, and the submission of false information, failure to provide required information or documents, or improper influence on the decision-making process. The bidder must also comply with rules concerning unlawful employment of foreign nationals, international sanctions, tax offences and any participation restrictions imposed by the contracting authority. The bidder must be able to confirm payment of taxes and social security contributions. Where an exclusion ground exists, the contracting authority may allow evidence of remedial measures demonstrating restored reliability. The bidder must also confirm that it will not use subcontractors or suppliers representing more than 10% of the contract value if they are Russian nationals, residents or entities established in Russia, majority-owned or controlled by such persons or entities, or acting on their instructions.

The bidder’s net turnover must have been at least EUR 50,000 excluding VAT in each of the last three financial years completed before the procurement began. During the last five years, the bidder must have properly completed at least two design contracts for a visitor centre, leisure building, accommodation building or another comparable building for public use, at least to preliminary design stage and including the documentation required for the building permit procedure. Each referenced building must have a gross ground area of at least 160 m² and meet at least energy class A requirements. Each reference project must include architectural, structural, heating, ventilation, water and sewerage, and electrical design. At least one reference must concern an accommodation or catering building, or a subcategory thereof. For each reference, the bidder must provide the contract dates, the other contracting party, the value, a description and, where applicable, the procurement reference number. Throughout the contract period, the team must include at least one person holding an authorised architect qualification at level 7 or an equivalent or higher qualification. The bidder must provide that person’s details and certificate number; for qualifications obtained abroad, a copy of the relevant licence or professional certificate, or other proof of the legal entitlement to perform the relevant work, must be submitted. The bidder must submit the European Single Procurement Document and a compliant tender. Conditional tenders are not permitted. In a joint tender, a power of attorney for the joint tenderers must be included. Where equivalence is relied upon, it must be explained and supported by evidence. The tender must identify any trade secrets and give reasons; the tender price and numerical indicators related to evaluation may not be classified as trade secrets.
