Compliance requirements
The bidder must confirm that the company, its management or supervisory board members, procurist or authorised representatives have no final convictions in the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or terrorism-related offences, money laundering or terrorist financing, or the illegal use of child labour or other forms of human trafficking. The bidder must also have complied with its tax and social security payment obligations. The notice also covers enabling an unlawfully staying foreign national to work and entering into a contract with a person subject to an international or Estonian Government sanction. Where applicable, a bidder may submit evidence of measures taken to restore its reliability. The required answers and any supporting evidence must be provided in the ESPD and, where applicable, in the manner specified in the tender documents.
Qualification criteria and exclusion grounds
During the three years preceding publication of the procurement, from 2023 onwards, the bidder must have completed at least two owner’s supervision contracts for construction works at publicly accessible sports or leisure facilities, including playgrounds or dog parks. Each facility must have a total floor area of at least 1,500 m², and the work must have been performed in accordance with the contracts and good professional practice. The references may arise from different contracts. For each reference, the bidder must provide the description, value, period, contracting authority details and other evidence required in the ESPD.
Throughout the contract period, the bidder must have a key person directly responsible for organising the owner’s supervision. The person must be a certified construction engineer at level 7 in the field of building construction or a certified road engineer at level 7 in the field of road engineering, excluding the initial qualification, or hold an equivalent qualification. The key person must have completed similar owner’s supervision services at at least three construction sites. The bid must identify the same specialist declared in the ESPD and include the specialist’s CV, professional certificate number and economic activity notification number. The key person must be registered by name in the Estonian Register of Economic Activities under owner’s supervision, activity type “road” or “general construction”.
The bidder must confirm compliance with all tender documents, submit an unconditional tender and follow the prescribed price structure. Where relevant, equivalence must be explained and supporting evidence provided. In a joint tender, an authorisation signed by the joint bidders must be included. Any claimed trade secret must be described and justified; the tender price may not be classified as a trade secret.
