Compliance requirements
The bidder must confirm that neither the bidder nor its administrative, management or supervisory body members or authorised representatives have received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. The bidder must also have no outstanding taxes or social security contributions and must not have breached obligations relating to the employment of unlawfully staying foreign nationals. Awarding the contract must not breach an international or Estonian sanction. Where an exclusion ground applies, the contracting authority may, where permitted, assess measures taken to restore the bidder’s reliability. For taxes and social security contributions, the bidder must provide a declaration or enable the contracting authority to verify the information through an official database.
Qualification criteria and exclusion grounds
The bidder’s team must include at least two specialists: one level 7 certified road engineer whose qualification covers road safety audits or equivalent competence, and one level 7 certified road engineer whose qualification covers project preparation or equivalent competence. Where work exceeds the relevant competence limits, the contractor must involve a person with the appropriate professional qualification. The required team must remain available throughout the contract period. The bidder must provide the responsible persons’ names, qualifications and professional certificate numbers in the ESPD; upon request, copies of professional certificates and education documents, together with the individuals’ consents to participate in contract performance, must be submitted. During the 36 months preceding publication of the contract notice, the bidder must have properly completed at least two road safety inspection or audit contracts. Upon request, the bidder must submit a list of those contracts stating the subject matter, client and contact details, performance period, value excluding VAT and, where applicable, the procurement reference number. The tender must comply with the tender documents, be unconditional and follow the required pricing structure. For a joint tender, a power of attorney for the joint tenderers must be included. Where applicable, an explanation and evidence of equivalence must be provided.
