Compliance requirements
A bidder may be excluded if it or its representatives have, within the previous five years or while an exclusion period remains in force, been convicted of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. Exclusion grounds also cover tax or social security contribution arrears; bankruptcy, insolvency, liquidation or comparable situations; suspended business activities; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest or an unfair advantage from involvement in preparing the procurement; and serious or persistent breaches of earlier contracts resulting in early termination, damages or comparable penalties. Grounds further include failure to meet environmental, social or labour obligations, submitting false or misleading information, withholding required information or documents, or improperly seeking confidential information. National grounds include enabling a foreign national to work unlawfully, a contract that would breach international or Estonian sanctions, and convictions for tax offences. The notice states a zero-euro threshold for tax and social security debts; however, an Estonian tax-debt certificate is not issued for debts below EUR 100 (excluding interest not determined by an administrative act) or where payment has been rescheduled. Where the law or tender documents permit, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must submit the participation application, equipment installation manuals, drawings showing the equipment layout in the room, the completed technical proposal and the price form. The technical proposal and price form must be submitted without changing their file formats. By submitting a bid, the bidder confirms compliance with the procurement documents; conditional bids are not permitted. If an equivalent solution is offered, its equivalence must be explained and supported with evidence. The bidder must confirm that the goods are not subject to international sanctions and do not originate from a sanctioned region, and that subcontractors or suppliers who are Russian nationals, residents or entities established in Russia, or are owned or controlled by such persons, will not be engaged for more than 10% of the contract value. In a joint bid, the bidders must submit an authorisation appointing a representative to act for them. The bidder must identify and justify any information designated as a trade secret; the bid price and figures relating to the award criteria may not be designated as trade secrets.
The bidder’s team must include a medical equipment specialist with at least 3 years of experience maintaining and repairing computed tomography scanners and manufacturer-provided training to maintain and repair scanners made by the manufacturer of the offered scanner. Evidence concerning the specialist must be submitted, and the bidder must ensure the specialist is available from handover of the equipment until the end of the period specified in clause 3.1.3 of the framework agreement.
