Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must confirm that neither the company nor persons with management, supervisory or representation powers are subject to any exclusion grounds. The provided European Single Procurement Document covers, among other matters, final convictions for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and the use of child labour or other forms of human trafficking. Payment of taxes and social security contributions is also checked; the threshold for tax or contribution debt is EUR 0, subject to the exceptions concerning deferred debt and tax debt below EUR 100 under Estonian tax procedure rules. The exclusion grounds also cover bankruptcy, insolvency or liquidation proceedings, suspended business activity, serious professional misconduct, agreements distorting competition, conflicts of interest, previous material breaches of public contracts, and the submission of false information or failure to provide required documents. Compliance with environmental, social and labour law obligations, rules concerning employment of unlawfully staying foreign nationals, international sanctions, and convictions for tax offences is also checked. Where an affirmative answer indicates a possible exclusion ground, the bidder must provide the required explanations and, where applicable, evidence of remedial measures demonstrating its reliability.

Qualification criteria and exclusion grounds

The supplied documents do not specify concrete requirements concerning bidder turnover, previous experience, certificates, or team qualifications; any such requirements must be checked in the tender documents. To demonstrate compliance, the bidder must submit the participation declaration using Annex 3, Form II, confirm that the tender complies with the procurement documents and the description in Annex 1, and submit the Annex 1 price offer form. Where applicable, the bidder must explain any equivalent solution and provide evidence of equivalence. The goods offered must not be subject to international sanctions or originate from a sanctioned region. Prices must be submitted in the required structure and must include all costs, including delivery and unloading at L. Puusepa 8, Tartu; the quoted prices are final for the contracting authority. In a joint tender, the bidders must submit the joint bidders’ power of attorney and confirmation of joint and several liability in accordance with Annex 3, Form I. Tenders may be submitted for both lots, and one bidder may be awarded a contract for both lots.
