Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory bodies, representatives or authorised persons have been finally convicted within the last five years of participating in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or other forms of trafficking in human beings. There must also be no breach of tax or social security payment obligations; the notice specifies a threshold of EUR 0, and the tax authority may not issue a tax-debt certificate, among other cases, where the debt is below EUR 100 or payment of the debt has been deferred.
The exclusion grounds also cover breaches of environmental, social and labour-law obligations, bankruptcy, liquidation or another insolvency situation, an agreement with creditors, assets administered by a liquidator or court, suspended business activity, serious professional misconduct, agreements restricting competition, conflicts of interest, serious breaches of previous contracts, false information or failure to submit required documents, and attempts to influence the procurement procedure or obtain confidential information. The procedure also checks breaches related to enabling the employment of unlawfully staying foreign nationals, the application of international sanctions, and convictions for tax offences. Where an exclusion ground applies, the bidder may, where permitted, submit evidence of remedial measures restoring its reliability.
Qualification criteria and exclusion grounds
The bidder must have completed comparable design services during the 36 months preceding the start of the procurement, with the contract completed no later than the month preceding the start of the procurement. The minimum number of completed works is 4, and the required scope may be fulfilled through separate projects or contracts:
- design of a second-stage water treatment plant with a capacity of 200 m³/day, including water treatment capacity of 15–30 m³/h and reinforced-concrete water tanks with a capacity of 100–200 m³;
- design of an SRB wastewater treatment plant with a capacity of 40 m³/day;
- design of external water supply and sewerage pipelines over 200 linear metres;
- design of at least 5 km of road and at least 500 m of streets.
The bidder must provide the experience details in the ESPD and a confirmation from the client's legal representative or contract contact person that the work was completed in the required scope and properly. For a contract performed under a public procurement procedure, the procurement reference number must also be provided.
The project team must include at least: a construction engineer responsible for managing the design work, level 7 or higher, specialising in building construction and competent in design management; a certified construction engineer, level 7, specialising in building construction and competent to prepare building design documentation; a road engineer, level 6, specialising in road construction and maintenance and competent to prepare road design documentation; and a certified water supply and sewerage engineer, level 7, specialising in external water supply and sewerage and competent to prepare the relevant design documentation. Qualification and experience details must be submitted for each person.
If the bidder relies on another entity’s capacity, it must submit that entity’s written and signed consent describing the capacity relied upon and confirming participation in contract performance at least to the extent for which its capacity is used. The tender must comply with all procurement documents, be unconditional, and its price must be submitted in the prescribed structure together with the required price schedule.
