Compliance requirements

The contracting authority will exclude a tenderer if any exclusion ground specified in Section 95(1) of the Estonian Public Procurement Act applies. In addition, the contracting authority may exclude a tenderer if the exclusion ground specified in Section 95(4)(8) applies. The tenderer must confirm whether any exclusion grounds apply to it.

Qualification criteria and exclusion grounds

The tenderer must have properly completed at least three contracts for the implementation of public awareness campaigns during the 36 months preceding the start of the procurement. The references must cover the creation and implementation of the campaign concept, planning and purchase of media space, campaign reporting, and presentation of results. An ongoing contract may be counted only to the extent and value completed, delivered to and accepted by the client by the start of the procurement. For each reference contract, the tenderer must provide the contract signing and completion dates, value, a brief description of the work, and the client’s name, email address and telephone number; for a public contract, the reference number must also be provided. Evidence of contract performance must be submitted at the contracting authority’s request. The tenderer must provide a list of the team members assembled to perform the contract, together with their roles. The tender price must be submitted on a project basis, according to the structure specified in the tender, and not as an hourly rate; the tenderer must also allow at least two feedback and revision rounds for the proposed solution at no additional charge. The tender must comply with all tender document requirements, and conditional tenders are not permitted. In the case of a joint tender, a power of attorney for the joint tenderers must be provided. The tenderer must identify and justify any information considered a trade secret; the tender price and numerical figures describing the tender in relation to the award criteria may not be designated as trade secrets.
