Compliance requirements
The bidder must not be subject to exclusion grounds, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, illegal child labour or other forms of human trafficking. The bidder must also not have outstanding tax or social security payment obligations, except where permitted by law. Exclusion grounds also cover bankruptcy, liquidation or other insolvency, breaches of environmental, social or labour law, serious professional misconduct, anti-competitive agreements, conflicts of interest, an unjustified advantage arising from involvement in preparing the procurement, serious breaches of previous public contracts, and the submission of false information or failure to provide required documents. National grounds are also checked, including enabling unlawful employment, breaches of international or national sanctions, tax offences, local tax debt owed in the contracting authority’s area, and participation restrictions. The bidder must confirm that neither it nor persons acting on its behalf have committed corrupt acts in this procedure and that no undertaking established or resident in the Russian Federation or Belarus, or relying on such persons’ resources, participates in the tender. Where an exclusion ground applies, evidence of remedial measures may be submitted in cases permitted by law or the procurement documents. Each subcontractor must separately confirm that the exclusion grounds under Section 95(1), points 1–5, of the Estonian Public Procurement Act do not apply to it.
Qualification criteria and exclusion grounds
The bidder’s total business turnover must have been at least EUR 120,000 in each of the last three financial years completed before the commencement of the procurement. The bidder must provide the three years of turnover data in the ESPD. If the information is not publicly available, the contracting authority may request an extract from the annual accounts or other evidence confirming the turnover.
Within the 36 months preceding publication of the contract notice, the bidder must have completed at least one similar design services contract as the main contractor. The reference must concern a building or building complex with at least 3,000 m² of enclosed net floor area and design completed at least to the detailed design stage, including a building permit or acceptance by the client. The work must include the architectural, structural, heating, ventilation, cooling, heat supply, water supply and sewage, electrical, fire safety and energy-efficiency parts. The bidder must provide the contract, client, contact person, floor area, duration and scope of responsibility, together with the other information required in the ESPD.
The team must include separate project manager and architect roles. The project manager must hold at least a level 7 diploma civil engineer qualification with competence in building construction and design management and/or preparation of building design documentation, or an equivalent level 7 authorised architect qualification. During the preceding 36 months, the project manager must have managed at least one similar design contract as the main contractor’s project manager. The architect must hold at least a level 7 authorised architect qualification or equivalent and must have worked during the preceding 36 months as the main contractor’s architect on at least one design project for a building or building complex exceeding 3,000 m² of enclosed net floor area, completed at least to the detailed design stage. The project manager and architect may not be the same person. Details must be submitted using the CV forms in Annexes 5.1 and 5.2. Qualifications issued in Estonia will be checked in the public professional qualifications register; for qualifications issued abroad, the bidder must submit a copy of the qualification document and, if requested during contract performance, a document from the competent Estonian authority confirming equivalence.
The tender must be submitted electronically through eRHR by the deadline, in a commonly readable file format and in Estonian. Foreign-language documents must include an Estonian translation. Conditional tenders are not permitted. The tender must include all required documents, comply with the procurement documents and follow the prescribed price structure to two decimal places. Joint bidders must submit a power of attorney and are jointly and severally liable for contract performance. If relying on another undertaking’s resources, the bidder must provide that undertaking’s consent and prove that the resources will actually be used; reliance on reference experience requires the supporting undertaking to perform the relevant contract or part personally. Any claimed equivalence must be explained and supported by evidence. The bidder must also provide details of managing or authorised persons not visible in the procurement register, or confirm that no such persons exist.
