The bidder must not be subject to exclusion grounds, including a final conviction within the last five years, or a still-applicable exclusion period, for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour and other forms of trafficking in human beings. These grounds may also concern members of the bidder's administrative, management or supervisory bodies, a procurator, or another person authorised to represent, control or make decisions for the bidder. The bidder must not have breached its obligations to pay taxes or social security contributions. The stated threshold for tax or social security debt is EUR 0; however, under the applicable rules, a tax debt certificate is not issued where the debt is below EUR 100 or payment has been deferred. The bidder must also not have enabled an illegally present foreign national to work or breached the conditions applicable to employing a foreign national in Estonia, including remuneration requirements. The bidder must confirm that entering into the contract would not breach an international or Estonian sanction. The offered goods must not be subject to international sanctions or originate from a sanctioned region. If an exclusion ground applies, the bidder may, where permitted by the tender documents, submit evidence of measures taken to restore its reliability.

The bidder must have completed at least one sales contract for goods similar to the subject matter of the tender during the 36 months preceding the start of the procurement. A similar contract means the sale of small equipment or sports equipment with a value of at least EUR 20,000 excluding VAT. The ESPD must include the contract description, value, dates and details of the other contracting party, including the customer's contact person's name, telephone number and email address; for a public contract, the reference number must also be provided. The document also states a minimum number of completed works of 2, although the detailed description requires one contract. This inconsistency must be checked in the tender documents or with the contracting authority before submitting a tender. The tender must comply with all tender document requirements and conditional tenders are not permitted. The price must be submitted in the required structure and using the Annex 2 price submission form, in euros excluding VAT and to two decimal places. Every line in Annex 2 must be completed without changes or added conditions. Unit prices and the total price must include all costs necessary for proper contract performance. Zero and negative prices are not allowed. The bidder must complete the Annex 1 specification, and all offered products must meet the technical requirements. Where necessary, equivalence must be explained and supporting evidence provided. For a joint tender, a power of attorney from the joint bidders must be submitted. The bidder must identify and justify any trade secrets; the tender price may not be classified as a trade secret.
