Framework agreement for ordering shelter plans

The bidder must confirm that neither it nor persons with management, representation or control powers have been finally convicted during the previous five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, or offences involving illegal child labour or human trafficking. The confirmations also cover whether an exclusion period imposed by a conviction is still in force; where relevant, information on the conviction and any measures taken to restore reliability must be provided. Exclusion may also apply for breaches of tax or social-security payment obligations; breaches of environmental, social or labour law; bankruptcy or other insolvency, liquidation, administration of assets by a liquidator or court, suspension of business activities, serious professional misconduct, agreements restricting competition, conflicts of interest, involvement in preparing the procurement, material breach or early termination of a previous contract, submission of false information or failure to provide required documents, or improper acquisition of confidential information. For tax and social-security payment obligations, the stated threshold is EUR 0; the tax authority does not issue a debt certificate where the tax debt is below EUR 100 or payment has been deferred. Companies established or resident in the Russian Federation or the Republic of Belarus may not participate, and the same restriction applies to entities whose qualifications the bidder relies on. The bidder must confirm that the goods offered are not subject to international sanctions and do not originate from sanctioned regions. Sanctioned Russian persons, companies, suppliers or subcontractors may not account for more than 10% of the contract value, and the bidder may not rely on their capacities. A false confirmation or a contract contrary to sanctions may result in rejection of the tender.

During the 36 months preceding publication of the contract notice, the bidder must have experience at at least two property sites in preparing shelter plans or equivalent safety plans and conducting safety training. The services must have been performed properly and in accordance with good practice. For each contract, the bidder must provide in the ESPD the contracting partner’s name and contact details, the site address, the contract period, the contract value and, where applicable, the procurement reference number. The contracting authority may request additional evidence and contact previous clients. The services must be delivered by a project manager with experience in preparing shelter plans or equivalent safety plans, conducting safety training and being responsible for the performance of similar contracts. This experience must, if requested, be supported by a client confirmation, contract or client-signed contract document. The bidder must also provide a specialist responsible for documentation assessing sheltering opportunities and proposing adaptations to shelter locations. This specialist must hold at least one of the following professional qualifications: Construction Engineer, level 6; Construction Manager, level 6; or Authorised Architect, level 7. Initial qualifications based solely on education are not accepted. The bidder must confirm that compliant specialists are available. In mini-competitions, CV information must be provided using Form 4; where several specialists are used, Form 6 must also identify the allocation of specialists to sites and the responsible project manager. The specialists named in the tender must be the persons who will actually perform the contract. The bidder must submit Form 2, the participation application, and the price in euros both in the procurement register’s price form and using Form 3. The price must be stated exclusive of VAT; cross-subsidisation and zero pricing are not permitted. For a joint tender, the bidder must submit the power of attorney and confirmation of joint and several liability using Form 8.
