Compliance requirements

The bidder must confirm that neither the company nor its representatives or controlling persons are subject to exclusion grounds, including final convictions for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or trafficking. The bidder must also have no outstanding tax or social security payment obligations, unless they have been properly settled or covered by a binding agreement. The exclusion grounds also cover breaches of environmental, social or labour law, bankruptcy or insolvency proceedings, liquidation, comparable financial distress, suspension of business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, serious or repeated breaches of previous public contracts, and false or withheld information or failure to provide requested documents. National grounds include enabling unlawful employment of foreign nationals, being subject to international sanctions, certain tax offences and restrictions on participation based on the bidder’s country of establishment. The bidder must provide the names and personal identification codes of authorised persons not shown in the commercial register, or confirm that there are no such persons. The bidder must also confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers subject to the specified Russian ownership, residence, citizenship or control restrictions. If submitting a joint tender, each joint bidder must provide a separate ESPD and the joint bidders must issue the required authorisation to their representative.

Qualification criteria and exclusion grounds

The bidder’s net turnover in the last financial year completed before the start of the procurement must be at least EUR 100,000. Joint bidders may aggregate their turnover. At the contracting authority’s request, the bidder must provide an extract from the relevant annual report or other documents proving the turnover, unless the information is publicly available to the authority from the commercial register. If relying on another entity’s financial capacity, the bidder must identify that entity in the ESPD; the supporting entity must provide the required consent, make the necessary financial resources available and accept joint and several liability for the relevant part of the contract. The bidder must have properly completed, during the 36 months preceding the start of the procurement, at least one contract for designing the construction of a publicly used road, with a value of at least EUR 100,000 excluding VAT. The bidder must submit a list of such contracts and, at the contracting authority’s request, a client confirmation stating that the contract was properly performed, together with the performance period and value excluding VAT. If relying on another entity’s technical or professional capacity, that entity must be identified in the ESPD, consent to the reliance and participate directly in performing at least the part of the contract for which its capacity is used. The bidder must accept all conditions in the contract notice and tender documents. The work and work-package handover and payment schedule must be completed in full, with amounts stated in euros to two decimal places, and submitted using the required Excel file without unauthorised changes. The bidder must identify any trade secrets and justify that designation. Required confirmations and documents must be submitted with the tender or upon request as specified in the tender documents.
