Compliance requirements
The bidder must confirm that neither it nor its representatives or controlling persons have received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing or the use of child labour. The exclusion grounds also cover outstanding tax or social security obligations, breaches of environmental, social or labour law, bankruptcy or other insolvency situations, suspended business activity, serious professional misconduct, agreements restricting competition, conflicts of interest, serious breaches of previous public contracts, and the submission of false information or failure to provide required documents. National grounds are also checked, including enabling illegal employment, sanctions-related circumstances, convictions for tax offences and breaches of restrictions on participation in the procurement. The bidder must provide responses to the exclusion grounds in the ESPD and, where applicable, evidence of measures taken to restore its reliability. The bidder must also confirm that the subject matter of the contract is not covered by international sanctions and does not originate from a sanctioned region, and must identify representatives or controlling persons not visible in the relevant registers or confirm that there are none.
Qualification criteria and exclusion grounds
The bidder’s net turnover must have been at least EUR 240,000 in each of the last three financial years completed before the procurement was launched. For a bidder using calendar years, turnover data must be provided for 2023, 2024 and 2025. Within the previous 36 months, the bidder must have completed at least one contract in a field corresponding to the subject matter, namely food laboratory analysis, with a value of at least EUR 30,000 excluding VAT. If the contract was concluded earlier or is still ongoing, the value completed during the previous 36 months must be stated. The bidder must provide the contract description, performance period, value, and the client’s name and contact details. The tender must include the required confirmations that the service complies with the tender documents, that all costs related to contract performance have been included, that the tender will remain valid for at least three months from the submission deadline, and that, if awarded the contract, the signed contract will be returned within five calendar days after receipt of the contract signed by the contracting authority. The tender must be submitted by the bidder’s legal or authorised representative; if the authority is not evident from the relevant register, a power of attorney using the form in Annex 2 to the tender documents must be submitted. For a joint tender, a power of attorney and confirmation of joint and several liability using Annex 3, as well as an ESPD for all joint bidders, must be provided. If the tender contains trade secrets, the relevant information must be identified and the classification justified. If an equivalent solution is offered, its equivalence must be explained and relevant evidence attached.
