Owner’s supervision services for construction works on Prangli Island’s water circulation system

The bidder must confirm that neither it nor members of its representative, management or supervisory bodies have been finally convicted during the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the unlawful employment of children or trafficking in human beings. The bidder must also have no outstanding tax or social security payment obligations and must not have breached rules concerning the employment of a foreign national without a lawful basis. The bidder must confirm that awarding the contract would not breach an international or Estonian sanction. Where an exclusion ground exists, the contracting authority may, where permitted, consider measures taken to restore the bidder’s reliability; those measures and supporting evidence must then be provided.

The bidder must have an economic activity notice in the Estonian Register of Economic Activities for owner’s supervision in the field of public water supply and sewerage. For this field, the competent person must hold the qualification of Chartered Water Supply and Sewerage Engineer, level 8. The bidder must provide, in the ESPD, a list of owner’s supervision service contracts completed during the previous 36 months. A qualifying contract is one under which the bidder supervised construction works for public water supply and/or sewerage facilities. The condition description states a minimum number of completed works of 2, while it also requires at least one such contract to have been properly completed; this inconsistency must be verified with the contracting authority or in the tender documents. The list must include, among other details, the contract description, value, performance period and client information. The contracting authority may request a client confirmation of proper performance, the period and the contract value. If relying on another entity’s capacity, the bidder must provide that entity’s details and ESPD and, upon request, its consent. The supporting entity must participate directly in contract performance at least to the extent for which its capacity is relied upon. In a joint tender, the partners must appoint an authorised representative and submit a power of attorney. The bidder must confirm that it will not use a subcontractor who would have to be replaced because of an exclusion ground. The tender must comply with all procurement documents, conditional tenders are not permitted, and the tender price must be submitted in the prescribed structure.
