Compliance requirements
A bidder must be excluded if the bidder or a person authorised to represent, manage, decide for or control it has been convicted of participation in a criminal organisation; breach of integrity or a corrupt act; fraud; terrorist offences or related participation; money laundering or terrorist financing; enabling unlawful employment or breaches of rules on employing foreign nationals, including paying below the statutory wage rate; or unlawful use of child labour or human trafficking. Exclusion also applies where the bidder has unpaid taxes, charges, environmental fees or social security contributions, or where awarding the contract would breach an international or Estonian government sanction.
The contracting authority may also exclude a bidder that has seriously or repeatedly breached a previous public contract, resulting in termination, withdrawal, a price reduction, compensation or a contractual penalty; or that has provided false information about meeting qualification criteria or failed to provide requested information or additional documents. Companies established or located in the Russian Federation or the Republic of Belarus may not participate.
Qualification criteria and exclusion grounds
The bidder’s net turnover in its most recently completed financial year must be at least EUR 100,000. The turnover must come from activities corresponding to the subject of the contract. The bidder must provide an extract from its annual report showing the turnover; this document is not required from an Estonian-registered legal entity if the information is publicly available to the contracting authority in a register. If the bidder’s financial year does not coincide with the calendar year, the requirement applies to its most recently completed financial year. At least six months must have elapsed between the end of that financial year and the bid submission date.
During the 36 months preceding the start of the procurement, the bidder must have properly performed at least two mowing-service contracts and at least one snow-clearing contract. The bidder must submit a list of these contracts using Form 2, “Information on previous contracts”.
The bid price must be submitted using Form 3 in Microsoft Excel format. The bidder must not alter the positions or quantities in the price table; a changed table will make the bid non-compliant. The indicative quantities are estimates and are not binding on the contracting authority. The successful bidder must use the contracting authority’s Elektrilevi Partner Portal (EPP) during performance of the framework agreement and must register for it before performance begins.
Joint bidders must appoint an authorised representative from among themselves for procurement-related matters and for concluding and performing the contract, and include the power of attorney with the bid. The bidder must identify any information claimed as a trade secret and explain why; the bid price and other specified numerical evaluation information may not be designated as trade secrets.
