Compliance requirements
The bidder must confirm that the company, its management or supervisory board members, and persons authorised to represent, control or make decisions on behalf of it have not received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the unlawful use of child labour or other forms of human trafficking. There must also be no continuing exclusion obligation. Where applicable, the bidder must describe measures taken to restore its reliability and provide supporting evidence.
Failure to meet tax or social security payment obligations is also an exclusion ground; the stated threshold is EUR 0. The bidder must confirm that entering into the contract would not breach international or Estonian sanctions and that it will not use, for more than 10% of the contract value, subcontractors or suppliers connected with sanctioned Russian persons or entities, including entities controlled by them or acting on their instructions. The bidder must also confirm that it will not use a subcontractor that must be replaced because of an exclusion ground. Breaches related to enabling an unlawfully staying foreign national to work are also subject to exclusion.
Qualification criteria and exclusion grounds
The bidder must submit the ESPD. This requirement also applies to all joint bidders, entities whose capacity is relied upon, and a foreign company on whose behalf a branch submits the bid. The successful bidder must provide supporting qualification documents at the contracting authority’s request.
For Lot 1, concerning events in Brussels, the bidder must have completed at least two contracts for organising international events during the 24 months preceding the start of the procurement. Each must concern a physical event, not a virtual or hybrid event, held outside Estonia and attended by at least 50 people. For Lot 2, concerning the Dominican Republic, the same requirement applies, but each event must have been attended by at least 100 people. Eligible events include seminars, workshops, training sessions, information days, conferences, forums and similar events whose primary purpose is not entertainment.
The ESPD must include a list of at least two qualifying contracts, with the event dates, number of participants and details of the other contracting parties; a procurement reference number must also be included where the contracts were performed as a result of a public procurement. The contracting authority may request confirmations from the other contracting parties. Experience gained under a framework agreement must be demonstrated through contracts concluded and completed under that framework agreement.
The bid must include the team members’ CVs for the selected lot, a description of the work sample and a detailed work-sample budget. The budget must include all costs associated with the services and products presented in the proposed solution, and the pricing must be realistic; the contracting authority may request price-list extracts or quotations to verify this. The bidder must confirm compliance with the tender documents and provide equivalence evidence where necessary. For a joint bid, a power of attorney for the joint bidders must be submitted, together with the names and personal identification codes of authorised persons not visible to the contracting authority in the official register, or confirmation that no such persons exist. The bid must identify and justify any trade secrets, but the bid price may not be classified as a trade secret.
