Compliance requirements
The bidder must confirm that it, its management or supervisory board members, procurists and other authorised representatives have not been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or illegal employment of children or offences related to human trafficking. The bidder must also have no outstanding taxes or social security contributions, subject to the exceptions described in the documents, and must not be bankrupt, undergoing liquidation or insolvency proceedings, subject to an arrangement with creditors, in a comparable situation, under the control of a liquidator or court, or have suspended business activities. Exclusion may also result from breaches of environmental, social or labour law obligations, serious professional misconduct, anti-competitive agreements, an unresolved conflict of interest, unfair involvement in preparing the procurement, serious or repeated breaches of a previous public contract, false or omitted information, failure to provide requested documents, or obtaining confidential information. The notice also checks the employment of unlawfully staying foreign nationals, compliance with international or Estonian sanctions, convictions for tax offences and the bidder’s legal right to participate. Where an exclusion ground exists, the bidder may provide evidence of remedial measures restoring its reliability if this is permitted by applicable law or the tender documents.
Qualification criteria and exclusion grounds
The bidder must meet the qualification and suitability requirements set out in the European Single Procurement Document and provide the required declarations and evidence. The machine-readable documents do not specify concrete thresholds for financial capacity, turnover or previous experience. The bidder must form a team comprising at least a project manager, a construction expert and an expert with experience in municipal administration, and submit their details using the required form. The tender must include a service description based on the technical specification, covering the initial substantive and methodological approach, the content and structure of the analysis and guide, an indicative work plan and schedule, and the project management approach. The tender price must be submitted in accordance with the structure provided for the award criteria and rated items. Conditional tenders are not permitted, and submitting a tender confirms acceptance of the conditions in the procurement documents. Eligible bidders must be established in Estonia, another European Union Member State, a European Economic Area contracting state or a country that has joined the World Trade Organization Government Procurement Agreement. A joint tender must include a power of attorney from the joint tenderers. During contract performance, the bidder must favour environmentally responsible solutions, including online meetings where possible, digital documents, appropriately sized files and deletion of unnecessary digital materials.
