Compliance requirements
A bidder may be excluded for relevant final convictions within the previous five years involving participation in a criminal organization, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. Exclusion grounds also include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, suspended business activity or comparable situations; and serious breaches of environmental, social or labour obligations or professional conduct rules.
Other grounds include agreements with other businesses intended to distort competition, an unresolved conflict of interest, involvement in preparing the procurement where the resulting competitive advantage cannot otherwise be remedied, and serious or persistent breaches of earlier contracts that led to early termination, damages or comparable sanctions. A bidder may also be excluded for false or misleading information, withholding required information or documents, attempting to improperly influence the procurement, or seeking confidential information for an unfair advantage.
National grounds include enabling a person without legal grounds to reside in Estonia to work, contracting with a person or entity in breach of international or Estonian government sanctions, and convictions for tax offences. For tax and social security debts, the stated threshold is EUR 0; however, the notice explains that the Estonian tax authority does not issue a debt certificate for a debt below EUR 100, excluding interest not established by an administrative act, or where payment has been deferred. Where applicable, the bidder may provide evidence of remedial measures to demonstrate its reliability.
Qualification criteria and exclusion grounds
The supplied documents do not set out specific financial, turnover, experience, or other qualification thresholds. Bidders must submit the completed participation application and the required price form, following its prescribed format and structure, and confirm that their bids comply with the tender documents. Conditional bids are not permitted.
For the offered products, bidders must complete the technical-description offer form and provide manufacturer-issued technical information in Estonian or English, such as product specifications or a catalogue. For each product, submit the manufacturer's declaration of conformity, instructions for use, packaging labelling and, where applicable, an EC certificate, as well as other documents confirming compliance. If offering an equivalent product or solution, explain the equivalence and provide supporting evidence.
Bidders must confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions. They must also confirm that they will not involve, for more than 10% of the contract value, subcontractors or suppliers that are Russian nationals, residents or entities established in Russia; are more than 50% directly or indirectly owned by such persons or entities; or act on their behalf or under their instructions. A bid that would make the contract void under the applicable sanctions law will be rejected.
Joint bidders must appoint an authorized representative from among themselves and include the relevant power of attorney with the bid. Bidders must identify any trade secrets in the bid and explain why the information qualifies; prices and price components, and other specified bid-evaluation figures, may not be classified as trade secrets.
The bid may receive 2 points if the bidder has a publicly accessible climate or environmental impact reduction objective, supported by a direct URL. The objective must express a general commitment to reducing environmental impacts or climate impacts, or seek to reduce significant impacts such as energy use, transport, water use, material circulation, waste or pollution. If a subsidiary relies on its parent company's objective, it must explain how that objective applies to the bidder.
