Compliance requirements
A bidder will be excluded if the company or a person with management, supervisory or representation powers has a relevant final criminal conviction for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, unlawful use of labour or human trafficking. Exclusion also applies where the bidder has outstanding national taxes, payments, environmental charges or social security contributions, or is subject to international sanctions. The contracting authority may also exclude a bidder for a serious or repeated breach of previous public contracts, or for submitting false information or failing to provide required information or documents. The bidder must confirm that none of these exclusion grounds applies.
Qualification criteria and exclusion grounds
Within the five years preceding publication of the contract notice, the bidder must have completed at least one line construction design project at 110 kV or higher. The bidder must submit a list of the relevant reference projects stating the client, a brief description, contract value, completion time and place, together with confirmation from the client that the contract was properly performed; confirmation is not required for contracts awarded by Elektrilevi OÜ.
The bidder must have at least one cable-line designer holding a valid electrical engineer qualification at level 7 or higher, or equivalent A-competence, and experience within the last five years of designing at least one similar project involving an object at 110 kV or higher. The bidder must submit the designer’s digitally signed CV, details of previous projects, and details and digitally signed CVs of the technical staff to be used. If the designer is not employed by the bidder, a written cooperation agreement or preliminary agreement must be provided.
The tender must include the completed price offer table with every unit-price field filled in, the expected work schedule, and the details of the contract signatory and contract-performance contact person. A power of attorney must be included if the signatory’s authority does not arise from the articles of association. By submitting a tender, the bidder accepts all conditions in the tender documents; conditional tenders are not permitted. The bidder must select a payment term: normally 14 calendar days for a contract value up to EUR 59,999, 35 calendar days for EUR 60,000–249,999, and 45 calendar days for EUR 250,000 or more; under the factoring programme, the term is 95 calendar days. If subcontractors are used, the bidder must submit their list, a description and percentage share of the subcontracted work, and their consent to participate and to the checking of mandatory exclusion grounds.
