Compliance requirements
The bidder must confirm that neither the bidder, its administrative, management or supervisory board members, nor persons authorised to represent or control it have received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or human trafficking. The bidder must also not have outstanding tax or social security payment obligations, except where permitted by law.
The notice also checks for bankruptcy, liquidation or other insolvency proceedings, administration of assets by a liquidator or court, suspension of business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, and serious breaches or early termination of previous public contracts. Grounds for exclusion may also include submitting false information, failing to provide required information or documents, or improperly influencing the contracting authority’s decision-making process.
The bidder must additionally confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers who are Russian citizens, residents or entities established in Russia, or entities directly or indirectly controlled by them, or persons acting on their behalf or instructions. The offered goods must not be subject to international sanctions or originate from sanctioned territories. ESPD answers must be accurate, and evidence or explanations of remedial measures may be required where an exclusion ground exists.
Qualification criteria and exclusion grounds
The machine-readable notice did not include precise financial capacity, turnover, previous experience, registration or staffing qualification requirements; these must be checked in the tender documents.
The bidder must submit an unconditional tender, confirm acceptance of all tender document requirements, and complete all required fields in the technical description and tender form. The tender must include Annex I, the technical description/tender form, and the price must be submitted in the structure specified in the worksheet titled “Award criteria and rated indicators”.
Before the tender submission deadline, at least one original-packaged cartridge sample must be provided for each offered product at Ravi 18/2, H building, Tallinn, unless the offered product is already in use at the contracting authority. The contact person for sample delivery is Kersti Tunger.
The product’s technical data must be supported by manufacturer information, such as a certificate of conformity, product catalogue, operating and maintenance instructions, technical data sheet or other relevant documentation. Where a joint tender is submitted, a power of attorney appointing the authorised representative must be attached. The bidder must also provide the name, position, telephone number and email address of the person who will sign the framework agreement and procurement contract if successful, as well as the person who will act as the contract performance contact. Where signing is based on authorisation, a power of attorney must be attached where necessary. The bidder must identify any trade secret and justify that designation, or state that the tender contains no trade secrets.
