Compliance requirements

The bidder must confirm that none of the exclusion grounds set out in § 95 subsection 1 of the Estonian Public Procurement Act apply. The contracting authority will verify compliance through registry data. The bidder must also confirm that it is not subject to a participation restriction based on its place of residence or registered office. Where necessary, the bidder must provide the URL, code and issuing authority for electronic verification of this information.

Qualification criteria and exclusion grounds

No separate selection or qualification criteria are specified in the ESPD. The bid must comply with the tender documents, and conditional bids are not permitted. For each desired lot, the bidder must submit a description of the offered goods and a price offer using the required Annex 1 form in spreadsheet format. The lot total must match the corresponding amount entered in the procurement register, and the price must include all costs, taxes and charges, including delivery of the goods to Pärnu Hospital Foundation at Ristiku 1, 80010 Pärnu. The bidder must provide additional product information if necessary and submit product samples within 3 working days if requested by the contracting authority. The bid must include the Annex 3 application, and its validity period must be 3 months. If the person submitting the bid or signing the contract does not have the relevant power of representation recorded in the commercial register, an authorisation must be attached. In the case of a joint bid, the bidders must submit a power of attorney for the joint bidders; the joint bidders will be jointly and severally liable for performance of the framework agreement. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from a sanctioned region. Any confidential information must be identified and justified; the bid price and numerical figures relating to evaluation may not be designated as trade secrets.
