Compliance requirements
The bidder must confirm that neither it nor its management, representative or supervisory persons have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. Compliance with tax and social security payment obligations is also checked; the stated threshold for tax debt is EUR 0, although special rules may apply where a debt is deferred or is below EUR 100. The exclusion grounds also cover bankruptcy, liquidation or insolvency proceedings, an agreement with creditors, suspended business activity, serious professional misconduct, anti-competitive agreements, conflicts of interest, serious breaches of previous procurement contracts, false statements or failure to provide required documents, and improper attempts to influence the contracting authority’s decision-making. Compliance with environmental, social and labour law obligations is checked, as well as offences involving employment of unlawfully residing foreign nationals, international sanctions, tax offences and local tax debt owed in the contracting authority’s location. Where an exclusion ground applies, evidence of measures restoring the bidder’s reliability may be submitted with the tender in an open procedure where this possibility is applicable.
Qualification criteria and exclusion grounds
The bidder must demonstrate that it has completed at least 3 contracts during the last 3 years involving the purchase of medical and special gases. For each contract, the bidder must provide, among other details, a description, value, performance period, client information and its area of responsibility, together with evidence or electronic references where required. The input does not specify a separate minimum turnover or other financial capacity requirement. The tender must include a valid document or copy issued by the manufacturer or an authorised supplier proving the right to sell the offered products, and, for medicinal products, a marketing authorisation from the State Agency of Medicines. At the time of submitting the tender and throughout the contract period, the bidder must have a sales point with a warehouse in Narva where the contracting authority can exchange empty gas cylinders and/or containers for filled cylinders and/or containers on working days from 8:00 to 16:00; a confirmation must be submitted. The tender must comply with the procurement documents and the technical description, and conditional tenders are not allowed. The technical tender must be submitted using the attached Form 2, “Price offer form 06082026.xlsx”, and the tender price must follow the structure specified by the contracting authority. The bidder must identify and justify any trade secrets; the tender price and evaluation-related figures that may not lawfully be classified as trade secrets cannot be designated as such.
