Compliance requirements
The bidder and persons with authority to represent, manage or control it must not have been convicted of participation in a criminal organisation, corruption, fraud, terrorism, money laundering, terrorist financing, illegal employment, breaches of foreign-worker employment conditions, unlawful child labour or human trafficking. The bidder must not have outstanding state tax, levy or environmental-charge debts, or tax or social-security debts under the law of its country of establishment, and contract award must not breach an international or Estonian sanction.
For a foreign company, joint bidder, subcontractor or relied-upon entity, evidence of the absence of exclusion grounds must be submitted, where requested or required by the tender documents, for the entity itself as well as its management and supervisory bodies and other persons authorised to represent, make decisions for or control it. The bidder must also provide a list of such persons who are not visible in the commercial register data.
The bidder may not use subcontractors or suppliers for more than 10% of the contract value if they are Russian citizens, residents or entities established in Russia, entities directly or indirectly more than 50% owned by such persons or entities, or representatives of or persons acting on the instructions of such persons or entities. A tender that does not comply with these requirements may be rejected.
Qualification criteria and exclusion grounds
The bidder’s total net turnover for the last three financial years completed before the start of the procurement must be at least EUR 270,000 excluding VAT, with at least EUR 90,000 in each year. Where necessary, compliance must be demonstrated with extracts from annual reports or other relevant documents. Joint bidders may rely on each other’s financial figures.
The bidder must have properly completed, during the 36 months preceding publication of the contract notice, at least one contract for the design of a 110 kV overhead line with a value of at least EUR 45,000 excluding VAT. The bidder must provide the contract description, the client’s name and contact details, the contract period and the contract value. The contracting authority may request additional evidence, including confirmation from the client.
Where the bidder relies on another entity’s capacities, it must submit a statement signed by that entity’s authorised signatory confirming the absence of exclusion grounds, consent to the reliance, participation in contract performance and joint responsibility for proper performance. The tender must include the required price table in euros excluding VAT, a financing schedule, team CVs and, where applicable, a representative’s power of attorney, a joint-bidders’ authorisation and a foreign commercial register extract or other evidence of representation authority. The bidder must confirm that it has reviewed the tender documents, holds the intellectual property and personal-data-processing rights needed for participation and performance, and accepts all compliance requirements.
