Compliance requirements
The bidder must confirm that neither the bidder, its management or supervisory body members, nor persons authorised to represent, make decisions for or control the bidder have relevant final convictions from the previous five years or a continuing exclusion obligation. The exclusion grounds cover participation in a criminal organisation, corruption, fraud, terrorist offences or offences related to terrorist activity, money laundering or terrorist financing, and the illegal use of child labour or other forms of human trafficking. The bidder must also have no outstanding tax or social security payment obligations; for tax debt, the documents state a EUR 100 threshold and treat deferred tax debt separately. The confirmations also cover violations concerning the employment of illegally staying foreign nationals and status as a subject of international sanctions. Undertakings established in the Russian Federation or the Republic of Belarus may not participate in the tender. First-tier subcontractors are checked during contract performance; they are not required to submit an ESPD, but the exclusion grounds apply to them. Where an exclusion ground exists, evidence of remedial measures restoring reliability may be submitted in cases where this is permitted or provided for in the tender documents.
Qualification criteria and exclusion grounds
- The bidder’s average annual turnover for 01.01.2023–31.12.2025 must be at least EUR 490,000.
- The technical experience section states a minimum number of completed works of 2, while the detailed description requires at least one properly completed construction contract during the previous 60 months. The contract must have involved the construction or reconstruction of a municipal water-system wastewater treatment pre-treatment or mechanical treatment facility, or a municipal stormwater or wastewater pumping station with technological equipment. The bidder must provide the contract name, client name and contact details, the period of performance and a brief description of the works; upon request, proof of proper performance must also be provided.
- The team must include a project manager and a site manager holding a level 6 water supply and sewerage engineering qualification, specialised in external water supply and sewerage and construction management, or an equivalent qualification; a design team manager holding a level 7 diploma-level water supply and sewerage engineering qualification, specialised in design management, or an equivalent qualification; and an electrical, automation and SCADA specialist holding a B-class electrical works competence certificate or equivalent. The project manager and site manager roles may be performed by the same person if the requirements for both roles are met.
- The bidder must submit the bidder’s team form. If a key person’s employer participates as a subcontractor or does not participate in the tender, the key person’s employer confirmation must be submitted.
- The bidder, a joint bidder or the relevant subcontractor must be registered in the Estonian Register of Economic Activities or an appropriate professional register in its country of establishment for construction of municipal water and sewerage systems, including pumping stations and treatment facilities, and for designing and constructing electrical installations. A foreign undertaking must provide proof of registration in its home-country professional register. A free-form confirmation of the required registrations must also be submitted.
- The completed unit-price table, Part IV, and, where applicable, an authorisation to sign, the joint bidders’ confirmation and all required tender forms must be included. The tender must comply with the procurement documents; where an equivalent solution is offered, its equivalence must be explained and supporting evidence provided.
- If subcontractors are used, Form 5 must be submitted, their scope and percentage share of the works must be described, and written consent from each listed subcontractor must be included. A subcontractor whose references are relied upon for qualification must submit a separate ESPD.
