Compliance requirements

The bidder must confirm that neither the bidder nor its management or supervisory body members, authorised representatives, procurators or other authorised persons who represent, control or make decisions for the bidder have been convicted of participating in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism, money laundering or terrorist financing offences. There must also be no convictions for enabling the employment of an unlawfully staying foreign national, breaching the conditions for employing a foreign national in Estonia, illegal use of child labour or human trafficking. The bidder must not have outstanding state tax, payment or environmental charge liabilities, or tax or social security payment debts under the law of its country of establishment. Contract award must not breach an international sanction or a sanction imposed by the Government of the Republic. The bidder must provide the relevant confirmation; where applicable, subcontractors subject to checks must also be identified.

Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register of its country of establishment where required by that country’s law. If registration is mandatory, evidence of registration must be submitted; a bidder established in Estonia does not have to submit a copy of its register document. During the 36 months preceding the start of the procurement, the bidder must have properly completed at least one contract for electrical and/or automation design services. Form 2, the list of contracts, must be submitted with the relevant contracts, dates and contracting parties, together with confirmation that the work was properly performed. If the bidder relies on a subcontractor’s reference or other resources of another entity, the subcontractor must be disclosed in the bid. The team responsible for the works must include at least one designer holding a Level 7 professional certificate as a certified electrical engineer with design competence, or an equivalent or higher Class B competence certificate, and at least one designer holding a Level 7 professional certificate as a certified automation engineer with design competence, or an equivalent or higher qualification. Form 3, the list of responsible specialists, and copies of documents proving the specialists’ qualifications and competence must be submitted. If a foreign bidder or foreign subcontractor does not hold documents issued under Estonian requirements, it must submit documents issued under the law of its country of establishment and confirm that it will obtain and submit confirmation from the Consumer Protection and Technical Regulatory Authority within one month after signing the contract. For a joint bid, the joint bidders must appoint an authorised representative and submit a power of attorney. The bid must comply with all tender document requirements, and conditional bids are not permitted. The bid price must be submitted using the required structure in Form 1; rows may not be deleted from the table. The bidder must identify and justify any trade secrets, but may not classify the bid price or numerical figures related to the award criteria as trade secrets.
