Compliance requirements
The bidder must declare whether it, or persons empowered to represent, manage or control it, have relevant convictions within the preceding five years, including for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and the use of child labour or other forms of human trafficking. Other grounds include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, suspended business activity or a similar situation; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing this procurement that creates an unavoidable competitive advantage; significant or repeated breaches of earlier contracts leading to early termination, damages or comparable sanctions; false or misleading information, failure to provide required information or documents, or improper attempts to obtain confidential information or influence the procurement. National grounds also cover enabling the unlawful employment of a foreign national, being subject to international sanctions, and relevant tax offences. The notice states that the tax-debt threshold is EUR 0; under Estonian tax rules, a certificate is not issued for debt below EUR 100 (excluding interest not established by an administrative act) or where payment has been deferred. Where permitted, the bidder may provide evidence of remedial measures demonstrating restored reliability.
Qualification criteria and exclusion grounds
The supplied documents do not specify financial-capacity, prior-experience, staffing or other precise qualification thresholds; check the official tender documents for any additional requirements. For each lot bid on, the bidder must confirm that its offer complies with the tender documents, submit the offer using the required pricing structure and provide the offer form with the information requested in Table 2. The bidder must also submit supporting product-compliance materials, such as declarations, certificates and product sheets. If offering an equivalent product or solution, explain the equivalence and provide supporting evidence. Conditional offers are not permitted. Joint bidders must appoint an authorised representative and include their power of attorney. The bidder must declare any information claimed as a trade secret and explain why; prices and evaluation-related figures may not be classified as trade secrets. The bidder must confirm that the goods are not subject to international sanctions and do not originate from sanctioned regions. It must also confirm that it will not involve, for more than 10% of the contract value, subcontractors or suppliers who are Russian nationals, residents or established in Russia, are more than 50% owned by such persons or entities, or act on their behalf or under their instructions.
