Compliance requirements
The bidder must confirm that neither the bidder nor its management, administrative or supervisory board members, authorised representatives or controlling persons have been convicted of participation in a criminal organisation, breach of duty of integrity, corruption, fraud, terrorism, money laundering, terrorist financing, enabling unlawful employment of a foreign national, breaches of foreign-worker employment conditions, unlawful use of child labour or human trafficking offences. The bidder must have no outstanding state tax, duty or environmental charge debts, and no tax or social security contribution debts under the law of its country of establishment. Contract award must not breach international sanctions or sanctions imposed by the Government of the Republic. These circumstances must be confirmed in the tender.
Qualification criteria and exclusion grounds
The bidder’s average annual net turnover in each of the last three financial years completed by the start of the procurement must be at least EUR 500,000. Joint bidders may aggregate their turnover figures, and turnover data for the three approved financial years must be submitted. During the 36 months preceding the tender submission deadline, the bidder must have properly performed at least one similar contract worth at least EUR 200,000. The contract must have covered feasibility analyses and market research required for procuring a power plant and related equipment, preparation of technical specifications, and advising the contracting authority on the construction of a power plant and procurement of equipment. Information on completed contracts must be provided, including signing and performance dates and client details. The bidder must operate a quality and environmental management system meeting ISO 9001:2015 and ISO 14001:2015 or equivalent standards; a certificate copy or a confirmation describing the system must be submitted. In a joint tender, an authorised representative must be appointed and a power of attorney from the joint bidders must be included. The tender must comply with all tender document requirements, and conditional tenders are not permitted. The bidder must identify any information claimed as a trade secret and provide reasons; the tender price and numerical figures related to the award criteria may not be classified as trade secrets.
