Compliance requirements
The tenderer and persons authorised to represent, manage, control or make decisions for it must not be subject to applicable exclusion grounds, including convictions for participation in a criminal organisation, corruption or breach of integrity obligations, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. Grounds also include outstanding tax, social security contribution or environmental-fee debts; enabling a person residing in the country unlawfully to work, or violating rules on foreign workers’ employment conditions, including paying below the statutory wage; and a contract that would breach an international or government-imposed sanction. The tenderer must confirm that these grounds do not apply and provide further evidence if the contracting authority cannot verify the information from public sources. For bids involving a foreign company, including through reliance on its capacity, a joint bid or subcontracting, provide evidence concerning that company and its relevant representatives that the exclusion grounds do not apply. Identify authorised representatives not shown in the relevant company register. The tenderer must also confirm that it will not use a subcontractor that would have to be replaced under the applicable rules.
Qualification criteria and exclusion grounds
The tenderer’s net turnover for the last three financial years completed before the procurement began must total at least EUR 2,520,000 excluding VAT, with at least EUR 840,000 in each year. Joint tenderers may rely on one another’s figures. If relying on another entity, submit its signed confirmation of consent and exclusion-ground compliance, explain how it will participate in contract performance, and confirm joint responsibility for proper performance. The contracting authority may request financial statements or other evidence, particularly where public records do not allow verification.
During the 60 months preceding publication of the contract notice, the tenderer must have properly performed at least one contract for construction works on a building with a concrete structure of any type. The contract must be worth at least EUR 420,000 excluding VAT, and at least that amount must have been paid to the tenderer for work performed during the specified period. Provide the contract description, client and contact details, contract dates, value, and details of any entity whose capacity is relied upon. Further evidence, including client confirmation, may be requested.
The bid must include a EUR 4,200 bid guarantee, either as a guarantee from a credit or financing institution or insurer valid throughout the bid validity period and for one further month, or as proof of payment into the contracting authority’s specified account. Submit the completed team CV form and documents demonstrating that the proposed shelter solution meets at least the requirements for a V1-class shelter. Include plans and dimensioned views or visualisations, a justified description of the base or support structure demonstrating safe and stable use on grass, and transport, loading, unloading and installation arrangements. The offered goods must be new, unused, defect-free and meet the technical requirements; explain and substantiate any proposed equivalence.
The bid must accept the tender-document conditions. If the submitter is not the tenderer’s legal representative, provide a power of attorney; foreign tenderers must provide evidence of the signatory’s authority. Joint tenderers must appoint an authorised representative and submit the joint tenderers’ authorisation and confirmation; they are jointly and severally liable for performance. A signed confidentiality agreement is required to obtain access to confidential documents, and the bid may be rejected if this agreement is not concluded. Identify and justify any trade secrets, but do not designate the bid price or evaluation-related figures as confidential.
