Compliance requirements
The tender documents include exclusion grounds based on criminal convictions, including participation in a criminal organisation, corruption, fraud, terrorist offences and other grounds listed in the ESPD. The bidder must confirm whether any such ground applies and, where allowed, provide evidence of self-cleaning measures and the required dates, reasons and supporting details. The documents also include subcontractor-related exclusion checks and sanctions-related confirmations.
Qualification criteria and exclusion grounds
The bidder must provide the qualification and compliance evidence required in the ESPD and tender documents. The minimum annual turnover requirement is EUR 20,000,000 for each of the last three completed financial years before the start of the public procurement procedure, and the bidder must provide the relevant turnover data or, if requested, the last three annual reports or extracts. The bid must include confirmation that, before the property rights agreement is signed, the bidder will at its own expense conclude construction all-risk insurance (CAR) and construction liability insurance and submit a copy of the policy; the property damage cover must be at least equal to the concession contract price and the personal injury/property damage cover must be at least 10% of the total concession value including VAT. The bid must comply with the tender documents, be unconditional, and include a bid security of EUR 50,000. If a joint bid is used, a power of attorney from the joint bidders must be attached. Where required, the bidder must also provide the business secret marking and justification, and confirmations related to subcontractors and sanctions.
