Compliance requirements
The bidder will be excluded if the bidder, or persons authorised to represent, make decisions for or control the bidder, are subject to any of the exclusion grounds under Section 95(1) of the Estonian Public Procurement Act. The confirmations must cover offences related to participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism, money laundering and terrorist financing, enabling illegal employment or violating the conditions for employing foreign nationals in Estonia, including payment below the statutory wage rate, illegal child labour and human trafficking.
The bidder must have no outstanding state tax, payment or environmental charge debt, or tax or social security contribution debt under the law of its country of establishment. Awarding the contract must not breach an international sanction or a sanction imposed by the Government of the Republic of Estonia. For a foreign company, joint tenderer, subcontractor or supporting entity, evidence of the absence of exclusion grounds may be required for the company and its management, supervisory and authorised representatives. If the contracting authority cannot verify the information through public registers, it may request additional evidence.
Qualification criteria and exclusion grounds
The bidder must have total net turnover of at least EUR 450,000 excluding VAT over the last three financial years completed before the procurement procedure began, with at least EUR 150,000 in each year. A foreign bidder, or a bidder whose information cannot be verified from public sources, may be required to provide extracts from annual reports or other evidence. Joint tenderers may rely on each other’s financial figures.
During the 36 months preceding the start of the procurement procedure, the bidder must have duly performed at least 3 contracts for wind power production forecasting services and at least 3 contracts for solar power production forecasting services. The services must have been provided in an EU Member State, the European Economic Area or the United States. The wind and solar references may overlap if the requirements for both categories are met. For each reference, the bidder must provide the contract name or description, the client’s name and contact details, the contract start and end dates, the value in euros excluding VAT, and a description of the service. The contracting authority may request additional evidence, including client confirmation.
If the bidder relies on another entity’s capacities, it must submit a written confirmation signed by that entity’s authorised signatory. The confirmation must address the absence of exclusion grounds, consent to the reliance, the entity’s participation in contract performance and the joint responsibility of the bidder and the supporting entity. The tender must include a properly completed price table in euros excluding VAT and the table of technical requirements for the renewable power forecasting service; the fields marked in yellow must be completed and the forms may not be substantively altered. If the tender is submitted by an authorised person, a power of attorney must be provided. Joint tenderers must appoint a common representative, submit the relevant authorisation and declaration, and are jointly and severally liable for contract performance. A foreign bidder may be required to submit a commercial register extract or other evidence of representation rights. The tender must identify any business secrets and explain their designation, or state that it contains no business secrets.
