The bidder must confirm that the company, its managers, representatives and controlling persons are not subject to any exclusion grounds. The checks cover final convictions for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, and the use of child labour or other forms of human trafficking. Compliance with tax and social security payment obligations is also checked; where arrears exist, the bidder must provide the relevant information and, where applicable, prove payment or the conclusion of a binding repayment agreement. Other exclusion grounds include bankruptcy, insolvency or liquidation proceedings, an agreement with creditors, assets administered by a liquidator or court, suspended business activity, serious professional misconduct, agreements distorting competition, conflicts of interest, material breaches of previous public contracts, false information or failure to submit required documents, and breaches of environmental, social or labour law. National grounds additionally cover enabling an unlawfully staying foreign national to work, international sanctions, and convictions for tax offences. Where an exclusion ground applies, the bidder may, where permitted by the tender documents and applicable law, submit evidence of remedial measures restoring its reliability.

The machine-readable notice did not specify financial capacity, turnover, previous experience or team qualification requirements. The bidder must submit a compliant tender and accept all conditions set out in the tender documents; conditional tenders are not permitted. The completed participation application, price form and technical description tender form must be submitted. The tender must include a list of the device, all accessories and other important components, including software and licences, together with a detailed technical description. Manufacturer-issued technical documentation in Estonian or English must be provided, such as manuals, safety data sheets, registration certificates and certificates of conformity with EN standards, so that compliance can be verified. The bidder must state the manufacturer’s prescribed routine maintenance frequency, maintenance activities and required time, and provide a list and prices of maintenance accessories, spare parts and consumables replaced or used during routine maintenance. A manufacturer-issued document or copy must prove that the bidder is the official representative and/or authorised reseller of the offered products. The price must be submitted using the required structure; in case of a discrepancy, the amounts in the document “312836 Price Form” will prevail. The bidder must confirm compliance with the tender documents and provide explanations and evidence of equivalence where an equivalent solution is offered. For a joint tender, a power of attorney for the joint bidders must be included. Any trade secrets must be identified and justified, but the tender price and figures relevant to evaluation may not be classified as trade secrets. Subcontractors or suppliers accounting for more than 10% of the contract value may not be Russian nationals, residents or entities established in Russia, nor entities or persons connected to them as specified in the tender conditions. The offered goods must not be subject to international sanctions or originate from sanctioned regions.
