The bidder must confirm that none of the exclusion grounds apply to the bidder or to members of its representative, management or supervisory bodies. These grounds include convictions for participation in a criminal organisation, breaches of integrity, corruption, fraud, terrorism, money laundering or terrorist financing. They also include convictions for enabling illegal employment, breaching the employment conditions of foreign nationals, illegal use of child labour or human trafficking. The bidder must not have outstanding national tax, payment or environmental-charge debts, and awarding the contract must not breach international or Estonian sanctions. Exclusion may also apply in the case of an unavoidable conflict of interest or a significant or repeated breach of a previous public contract resulting in withdrawal from or termination of the contract, a price reduction, compensation or a contractual penalty. The bidder must also confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers who are Russian citizens, residents or entities established in Russia, or entities controlled by such persons. An incorrect confirmation may lead to rejection of the tender.

No separate economic or technical selection criteria are stated in the ESPD, but the following compliance requirements apply: - The bidder must provide at least one photographer for the entire contract period, with the competences specified in point 4.2 of Annex 1 to the tender documents. - Within the 36 months preceding publication of the tender, the photographer must have completed at least 3 contracts or orders involving outdoor photography of objects, including buildings or structures. - A detailed photographer’s CV must be submitted with the tender using the form in Annex 3, allowing the contracting authority to verify the experience and competences. - The tender must comply with all tender documents; conditional tenders are not permitted. - The tender price must be submitted according to the structure specified in the pricing and evaluated-indicators sheet. - In the case of a joint tender, an authorisation from the joint tenderers must be submitted. - Where applicable, an equivalent solution and supporting evidence must be included with the tender. - The bidder must identify and justify any trade secrets, but may not classify the tender price or numerical indicators related to the evaluation of the service as trade secrets.
