Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder may be excluded if it or a person authorised to represent, manage or control it has a relevant final conviction within the previous five years, including for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour and other forms of human trafficking. Exclusion may also apply for unpaid taxes or social security contributions, bankruptcy or insolvency proceedings, liquidation, creditor arrangements, suspended business activity, serious professional misconduct, competition-distorting agreements, an unresolved conflict of interest, involvement in preparing the procurement that creates an unavoidable competitive advantage, or serious or repeated breach of an earlier public contract resulting in termination, damages or a comparable penalty. Grounds also include false or misleading information, withholding required information or documents, improper attempts to influence the procedure or obtain confidential information, and breaches of environmental, social or labour obligations. National grounds include enabling a foreign national without legal basis to work, entering into a contract that would breach an international or Estonian government sanction, and certain tax offences. Tax and social contribution debts are assessed under the applicable national rules; in Estonia, a tax-debt certificate is not issued where the relevant debt is below EUR 100 or payment has been rescheduled. Where legally available, the bidder may provide evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The bidder must meet these qualification and compliance requirements: - Its total annual net turnover must have been at least EUR 1,500,000 in each of the last three financial years completed by the start of the procurement. Where the bidder was established or began trading later, only completed financial years since that date are considered. If it cannot provide the requested documents for a valid reason, it may provide other documents accepted by the contracting authority to demonstrate its financial standing. - During the 36 months preceding the start of the procurement, it must have properly completed at least three sales contracts or orders for goods similar to those in the technical specification. Their combined value must be at least EUR 200,000 excluding VAT. The bidder must provide a list showing the contract dates, description, customer details and value excluding VAT. For contracts extending beyond the reference period, only the value of goods delivered and accepted during the period counts; for framework agreements, completed contracts awarded under them may be used. - The bid must include the completed pricing form and prices in the structure specified in the pricing schedule. Conditional bids are not permitted, and submission confirms acceptance of the tender-document requirements. - The bidder must provide manufacturer product information or other documents, including evidence of compliance with standards, enabling verification that the products meet the technical specification. Documents must be in Estonian or English; documents in another language must include an Estonian translation. Where an equivalent product or solution is offered, its equivalence must be explained and supported by evidence. - Before the bid deadline, the bidder must deliver one summer and one winter shirt sample, each in size 104/180, to Pärnu mnt 139, Tallinn. Samples must be made from the correct material, bear identification labels and be packed in a closed, opaque package that protects them during normal handling. The products themselves must not identify the bidder. The package must bear the bidder and contact details, the contracting authority’s delivery details, the procurement reference and the required instruction not to open before the bid deadline. The delivery time must be agreed with the contracting authority’s contact person at least two working days in advance. Late or missing samples, or samples that do not meet the technical requirements, result in rejection. Samples may be in any colour. Unsuccessful bidders may arrange collection within 30 calendar days after the procurement procedure ends; the successful bidder’s sample will be used as a reference when checking the first contract delivery and resolving later claims. - The bid must include dark-blue and green fabric samples measuring at least 4 × 4 cm, together with the manufacturer’s specification and colour code. It must also include the required material samples, each at least 4 × 4 cm, and their specifications, so the materials can be checked against the technical specification. Estonian-language care instructions for the materials must be provided. - The bidder must accept the maximum delivery periods set out in Annex 2. - The bidder must confirm that the supplied goods are not subject to international sanctions and do not originate from sanctioned regions. It must also confirm that subcontractors and suppliers connected to Russia will not perform more than 10% of the contract value, including Russian citizens, residents or entities established in Russia; entities more than 50% directly or indirectly owned by them; and persons or entities acting on their behalf or under their direction. - In a joint bid, the bidders must appoint an authorised representative and include the joint bidders’ power of attorney. The bidder must identify any trade secrets and explain why the information qualifies; prices and other evaluation-related figures may not be designated as trade secrets.
