Summary

The procurement concerns on-demand daily catering services for the Police and Border Guard Board and its partners during routine work, exercises, planned and unplanned operations, and crises. The tender has six lots covering Narva and Ida-Virumaa, Haapsalu and Läänemaa, Paide and Järvamaa, Rapla and Raplamaa, Rakvere and Lääne-Virumaa, and Valga and Valgamaa. A framework agreement will be concluded with up to three bidders per lot for 24 months, with a possible extension of up to 24 additional months. The service provider must be able to serve orders from one person to groups of approximately 10–50 or 100–500 people. Bidders may submit tenders for all six lots, and contracts may be concluded with one bidder for all six lots.

Compliance requirements

The bidder must confirm that neither it nor members of its management, administrative or supervisory bodies, or persons authorized to represent it, have been finally convicted within the last five years of participation in a criminal organization, corruption, fraud, terrorist-related offences, money laundering or terrorist financing, illegal use of child labour or human trafficking. Where applicable, the bidder must provide details of the conviction and describe measures taken to restore its reliability. The bidder must not have breached its obligations to pay taxes or social security contributions. The threshold for tax or social security debt is EUR 0, subject to the exception described in the European Single Procurement Document for debt below EUR 100 or debt being paid under a payment schedule. The bidder must be able to prove payment of taxes and contributions or compliance under a binding settlement. A ground for exclusion also applies where the bidder has enabled an unlawfully staying foreign national to work or breached the conditions for a foreign national working in Estonia, including paying less than the statutory wage rate. Contracting with the bidder must not breach an international or Estonian sanction. The bidder must provide the relevant confirmations and, where necessary, additional evidence.

Qualification criteria and exclusion grounds

The machine-readable procurement passport does not set out separate turnover, previous experience, staffing or professional qualification requirements. The bidder must nevertheless submit a compliant tender for each desired lot and follow the compliance requirements. For each lot, the bidder must submit a sample tender using the contracting authority’s form, offer all products and services listed on the form, and provide prices excluding VAT. All fields must be completed with the required information. Prices must be stated to no more than two decimal places and must match the tender price entered in the register; otherwise, the tender will be rejected. Conditional tenders are not permitted. A transport cost form must also be submitted. For orders of at least EUR 50, delivery must be free of charge in the city specified for the relevant lot. For orders below EUR 50, the bidder must provide a one-off fixed transport charge; for deliveries elsewhere, a one-way price per kilometre must be provided. The bidder must confirm that it will not use, for more than 10% of the contract value, suppliers or subcontractors who are Russian Federation citizens, residents or entities established in the Russian Federation, or entities more than 50% directly or indirectly owned by such persons or acting on their instructions. The offered goods must not be subject to international sanctions or originate from sanctioned regions. In the case of a joint tender, a power of attorney for the joint bidders must be submitted. The tender must identify any confidential business information and explain the basis for confidentiality, but the tender price and numerical figures corresponding to the award criteria may not be classified as trade secrets. If selected, the bidder must provide the details of the contract signatory and contact person and sign the framework agreement on the terms set out in the draft agreement.
