Compliance requirements
The tender passport requires bidders to declare whether the company or its relevant managers or representatives have final convictions for criminal offences, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, child labour or human trafficking. It also covers unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, creditor arrangements, a liquidator managing the bidder’s assets or suspension of business; serious professional misconduct; competition-distorting agreements; conflicts of interest or involvement in preparing the procurement; serious or repeated failures under previous contracts; false or misleading information, failure to provide information or requested documents, and attempts to obtain confidential information or improperly influence the procedure. National grounds also include enabling unlawful employment of foreign nationals, international sanctions, any specified local tax debt, tax offences and restrictions on a bidder’s right to participate. Where a ground applies, the bidder may provide information about remedial measures where permitted.
Qualification criteria and exclusion grounds
The bidder must have completed at least one contract for the sale of furniture and/or furnishing products during the 36 months preceding the start of the procurement, with a value of at least EUR 30,000 excluding VAT. The bidder must provide a list of completed contracts, including the contracting party’s name and contact details (email and telephone), contract signing and completion dates, and, for public contracts, the reference number. For a contract that is ongoing or partly outside the reference period, only the portion completed, delivered and accepted within the reference period may count; framework agreements are evidenced by completed orders or projects under them. The contracting authority may contact the other contracting party to verify the information.
The offer must follow the prescribed price-submission structure and include technical information for the specified student desk, teacher desk, student chair and multifunctional modular table with a folding top: manufacturer and model, product description or data sheet with information on compliance with standards, and a photograph or link to one. The offer must confirm acceptance of the tender-document conditions without reservations and explain any claimed equivalence, with supporting evidence where necessary. It must also identify authorised representatives not visible in the business register. Joint bidders must provide a power of attorney for their authorised representative. The bidder must declare any trade secrets and justify that designation.
The bidder must confirm that all wood used in the furniture comes from legal sources and provide evidence on delivery, such as an FSC certificate or FLEGT or CITES licence. Furniture must be disassemblable with hand tools so that an untrained person can replace parts; disassembly and repair instructions must be delivered with it. The offer must disclose REACH candidate-list substances present above 0.1% by weight in the product or any component or material, and evidence of their presence or absence must be provided when the furniture is delivered. The furniture must have a warranty of at least two years from delivery, covering repair and a replacement product during repairs at no extra cost; the authority may require a longer warranty. Spare parts or functionally equivalent components must remain available for at least two years after delivery. The bidder must also confirm that the goods are not subject to international sanctions and do not originate from sanctioned regions, and be prepared to supply the additional products described in the technical specification.
