Compliance requirements
A bidder may be excluded if it or a person authorized to represent, manage or control it has, within the previous five years or while an exclusion period remains in force, been convicted by a final judgment of participation in a criminal organization, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. Exclusion also applies for the specified offences involving the employment of a foreign national without legal grounds or breaches of the conditions for employing foreign nationals in Estonia. The bidder may be excluded for outstanding tax, environmental charge or social security contribution debts, or if awarding the contract would violate an international or Estonian government sanction. For tax debts, the notice states that amounts below EUR 100 are not treated as reportable debt in the circumstances described, including where payment has been rescheduled. Where legally applicable, the bidder may provide evidence of measures taken to restore its reliability.
