Compliance requirements
The bidder must declare whether it or any person with powers of representation, decision-making or control has, within the last five years or while an exclusion period remains in force, been convicted of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour or human trafficking offences. The bidder must also disclose relevant convictions for enabling the unlawful employment of a foreign national and tax offences.
Other grounds include unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, an arrangement with creditors, administration of assets by a liquidator or court, suspended business activity, or a comparable situation; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement that gives an unfair advantage which cannot otherwise be prevented; serious or persistent failures under earlier public contracts resulting in early termination, damages or comparable sanctions; false or misleading information, failure to provide required information or documents, or improperly obtaining confidential information. A further ground applies where contract award would breach an international or Estonian government sanction, or where the bidder is not legally entitled to submit an offer under any applicable participation restriction. Tax-debt information notes that an Estonian tax certificate is not issued for debt below EUR 100 (excluding interest not established by an administrative act) or where payment has been deferred. The bidder must also confirm that it will not involve a subcontractor who is subject to mandatory replacement, and comply with the stated restriction on Russian-linked subcontractors and suppliers.
