Compliance requirements
A tenderer may be excluded if it or its representatives have relevant convictions, including for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. Other grounds include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, creditor arrangements, administration of assets by a court or liquidator, or suspension of business; serious professional misconduct; breaches of environmental, social or labour obligations; agreements that distort competition; an unresolved conflict of interest or involvement in preparing the procurement; and serious or persistent failures under previous contracts leading to early termination, damages, a price reduction or comparable penalties. Exclusion may also follow from false or misleading information, withholding required information, failure to provide requested evidence, attempts to improperly influence the procedure or obtain confidential information, enabling the unlawful employment of a foreign national, being subject to applicable international sanctions, or relevant convictions for tax offences. For tax and social security debts, the stated threshold is EUR 0; under the Estonian tax rules described in the documents, a tax-debt certificate is not issued where the debt is below EUR 100 or payment has been rescheduled. Where permitted, the tenderer may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
No specific financial, turnover, experience or staffing qualification thresholds are stated in the available documents. The tenderer must submit an unconditional bid accepting the tender-document requirements, provide the requested details for the proposed contract signatory and contract contact, complete the pricing sheet in its prescribed structure, and submit the technical offer using the tender’s technical-description form.
All offered products must bear the CE marking and comply with Medical Device Regulation (EU) 2017/745. Submit manufacturer-issued conformity documents and technical documentation that allows the contracting authority to verify the products’ characteristics and compliance. If requested by the contracting authority, submit 3 product samples for testing within 5 working days of receiving the request. Samples must be delivered in sealed, labelled packaging identifying the procurement, reference number and tenderer. Failure to provide them on time makes the bid non-compliant.
Where the tender documents refer to standards, labels, sources or other specified characteristics, equivalent products or evidence may be offered; the tenderer must explain and substantiate equivalence. Identify any information claimed as a trade secret and justify the claim. The bid price and other specified evaluation-related figures or indicators may not be classified as trade secrets. The tenderer must confirm that the goods are not subject to international sanctions and do not originate from sanctioned regions. Where the applicable EU restriction applies, no more than 10% of the contract value may be performed by subcontractors or supplied by suppliers covered by the specified Russia-related restrictions.
