Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

A bidder may be excluded for specified final convictions within the relevant period involving criminal organisations, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. Exclusion may also apply for unpaid taxes or social security contributions, and for breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, an agreement with creditors, court or liquidator control of assets, or suspended business activity; serious professional misconduct, anti-competitive agreements, an unmanageable conflict of interest or improper involvement in preparing the procurement; material breach of previous contracts resulting in early termination, damages or comparable sanctions; false or misleading information, failure to provide required information or documents, or attempts to obtain confidential information or improperly influence the procedure. National grounds include enabling a foreign national to work unlawfully, being subject to international sanctions, and certain tax offences. The notice states a zero threshold for tax and social security debts; in Estonia, a tax-debt certificate is not issued where the debt is below €100 or payment has been rescheduled. Where legally permitted, the bidder may provide evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The bidder’s net turnover in the last three financial years completed before the procurement began must total at least €90,000,000. The bidder must have completed, as the main contractor within the 60 months before the procurement began, at least two similar construction contracts for buildings or building complexes with a closed net floor area exceeding 5,000 m² and construction works valued at least €15,000,000 excluding VAT per contract. Completion means that an occupancy permit has been issued. Similar works include construction, extension or full reconstruction of public buildings for entertainment, education, healthcare or other public uses, or buildings with equivalent uses. The bidder must provide contract details, including the client and contact details, floor area and contract period; where applicable, the procurement reference number. The bid must include the completed participation application, price schedule, and forms for design and construction specialists. Subcontractor, joint-bidder authorisation and reliance on another entity’s resources forms must also be provided where applicable; if forms 5–7 do not apply, submit blank documents. The subcontractor list must identify each subcontractor, the work or service and its percentage share, and be signed by each subcontractor’s legal or authorised representative. If an authorised representative signs, include the power of attorney. The bidder confirms that listed subcontractors have consented to participate, that their employees’ average wages during the relevant reference period were at least 70% of the average wage in the corresponding field, and that the bidder will not use a subcontractor who must be replaced due to exclusion grounds. Other subcontractors may be used during contract performance only with the contracting authority’s consent. For furniture, the bidder must confirm that the wood comes from legal sources and provide evidence on delivery; declare REACH candidate-list substances present above 0.1% by mass and provide evidence on delivery; and supply furniture that can be dismantled and repaired using hand tools, together with dismantling and repair instructions. The furniture warranty must be at least two years from delivery, covering repair and a replacement product during warranty repairs, and spare parts or functionally equivalent components must be available for at least two years after delivery. The bidder must also confirm compliance with the applicable international sanctions restrictions on subcontractors, suppliers and goods. Price is the only award criterion stated in the available material.
