Compliance requirements
A tenderer may be excluded for relevant convictions involving participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking; for failure to pay taxes or social security contributions; or for bankruptcy, insolvency, liquidation, suspension of business or similar circumstances. Other grounds include serious professional misconduct, competition-distorting agreements, an unmanageable conflict of interest, involvement in preparing the procurement that creates an unavoidable competitive advantage, or significant or repeated breach of an earlier contract resulting in early termination, damages, a price reduction or a penalty. Exclusion may also result from false or misleading information, withholding information or required documents, improperly seeking confidential information, breaches of environmental, social or labour obligations, enabling unlawful employment of a foreign national, international sanctions, or convictions for tax offences. For tax and social contribution arrears, the stated threshold is EUR 0; under Estonian rules, a tax debt below EUR 100 or a deferred debt may not result in a tax-debt certificate being issued. Where legally permitted, the tenderer may provide evidence of measures taken to restore its reliability.
